Translation of the polish deed of association into German- linguistic and cultural aspects

Celem pracy pt. „Lingwistyczne i kulturowe aspekty tłumaczenia umowy sp. z o.o. z języka polskiego na niemiecki” jest zbadanie założeń tekstualno-lingwistycznych, kulturowych i językowych niezbędnych przy tłumaczeniu umowy sp. z o.o.. Tekst ten nie jest tylko nośnikiem informacji o nowo założonej spółce, ale służy także jako narzędzie komunikacji między jej autentycznymi adresatami, czyli prawnikami. Znajduje to również wyraz na płaszczyźnie językowej. Jako tekst prawniczy umowa sp. z o.o. musi przestrzegać pewnych zasad, takich jak postulat precyzji wyrażania i nieokreśloności zarazem. Tłumaczenie umowy sp. z o.o. nie może być pojmowane wyłącznie jako przekładanie pojedynczych pojęć z jednego języka na inny. Zdecydowanie należy uznać, iż mamy w tym wypadku do czynienia z transferem kulturowym i złożonym procesem decyzyjnym, który podlega jednak pewnym regułom. Jako tekst mocno zakotwiczony w kulturze danego państwa umowa sp. z o.o. budowana jest według obowiązujących przepisów. Jej postanowienia muszą być zgodne z literą prawa. Toteż przed podjęciem tłumaczenia należy zbadać różnice między systemami prawnymi obydwu państw posługując się technikami komparatystyki prawnej.Specyfika systemów prawnych przekłada się również na płaszczyznę językową. Choć zarówno w języku prawa polskiego jak i niemieckiego istnieją takie kategorie jak nakazy, zakazy, pozwolenia, czy też upoważnienia, to jednak niejednokrotnie są one wyrażane za pomocą innych środków językowych, co z kolei należy uwzględnić przy tłumaczeniu.

The target of the MA thesis “Translation of the polish deed of association into German- linguistic and cultural aspects” is to analyze the text-linguistic, cultural and linguistic premises of the translation of this document.This text is not only an information carrier about the set up company, but rather a mean of communication between lawyers- the authentic addressees of such documents. As a legal text the deed of association has to obey certain linguistic rules. On the one hand it has to be precise, on the other hand indeterminate, so that it will be able to regulate many different situations. The translation of the polish deed of association cannot be seen as a simple transferring procedure from one language into another. It must be stressed, that in this case we are rather confronted with cultural transfer and a complex decision-making process.The deed of association originates in the legal system of a country. The translator has to be aware of the differences between both legal systems. Through using the methods and techniques of the comparative law he has to identify those differences in order to formulate the target text properly. The specificity of the legal system has also a great influence on the linguistic sphere of contracts. Although both legal systems distinguish between such categories like commands, permissions, authorizations and prohibitions, each language has in many cases different means of expression. The translator needs to learn, which of them are used in the particular situation.

In der vorliegenden Arbeit werden die Voraussetzungen für die Übersetzung des polnischen Sp. z o.o.-Vertrags ins Deutsche untersucht. Die Analyse wird im Wesentlichen in drei Bereichen durchgeführt. Erforscht werden die textlinguistischen Eigenschaften, die gesetzlichen Unterschiede in der Funktionsweise des Rechtsinstituts Gesellschaft mit beschränkter Haftung als Reflex des kulturellen Subsystems, sowie die in den Verträgen verwendeten sprachlichen Ausdruckmittel.
