Praca pt. "Dodatkowe prawo ochronne na produkty lecznicze", przedstawia i wyjaśnia regulacje związane z dodatkowym prawem ochronnym. Rozpoczynając od podstawowych przepisów dotyczących przesłanek patentowalności, kontynuując przez ideę przyświecającą Unijnemu Prawodawcy przy tworzeniu instytucji dodatkowego świadectwa ochronnego, związanych z nią wymagań aż do korzyści które daje. Praca zbudowana jest tak, by była zrozumiała dla odbiorcy niekoniecznie związanego z dziedziną prawa ale jednocześnie wyczerpywała zagadnienia związane z dodatkowym prawem ochronnym. Zawiera niezbędną wiedzę w temacie świadectwa ochronnego podpartą orzecznictwem sprzyjającym poszerzaniu spektrum świadomości związanej z tymi reglacjami.
This bachelor’s thesis is a presentation of Supplementary Protection Certificate (SPC) – one of relatively new industrial property law regulations. It shows clearly the notion of SPC, where and how can it be obtained as well as what are its advantages and constraints. The thesis structure follows the logical pattern of problem presentation: it begins with the basic regulations and laws that have to be understood in order to proceed and get into more profound aspects of SPC. It commences with the most simple patent conditions, followed by the idea of supplementary certificate. Further chapters contain definitions related to SPC subject, conditions that have to be met in order to be granted such certificate as well as some specific features that have been developed through judicature. All that content is supported by European Court’s of Justice sentences, provisions and opinions.The pharmaceutical industry market is characterized by high velocity of development and therefore, is not stable, what has been proven by numerous different preliminary questions and rulings, raised before the Court of Justice of the European Union. Some of those are included in the thesis to prove a point and provide further insight and interpretations on various laws and definitions to be adopted by the local authorities in industrial property law sector in future scenarios.
