The right to a noise-free environment on the basis of article 8 of European Convention on Human Rights

Praca skupia się na omówieniu prawa do środowiska wolnego od hałasu oraz jego związku z artykułem 8 Europejskiej Konwencji Praw Człowieka. Rozdział pierwszy dotyczy ogólnie pojętego prawa do środowiska oraz definicji zanieczyszczenia hałasem. Uwagę poświęcono rozwojowi prawa do środowiska odwołując się do dokumentów mających największy wpływ na jego rozbudowę i koncepcji włączenia go w poczet praw człowieka. Podejmowany jest także temat zanieczyszczenia hałasem, jego przyczyn, skutków oraz unormowań prawnych z nim związanych. Rozdział drugi traktuje o prawie do poszanowania życia prywatnego i rodzinnego wynikającego z artykułu 8 Europejskiej Konwencji Praw Człowieka. Omawiana jest jego budowa, najważniejsze z perspektywy środowiskowej zasady interpretacji oraz kategorie obowiązków z niego wywodzonych, ze szczególnym uwzględnieniem obowiązków pozytywnych państw. Rozdział trzeci jest analizą orzecznictwa Europejskiego Trybunału Praw Człowieka dotyczącego zanieczyszczenia hałasem stanowiącą próbę określenia, kiedy, według Trybunału, mówić można o hałasie naruszającym prawo do poszanowania życia prywatnego i rodzinnego.

This paper focuses on the right to a noise-free environment and its relation to Article 8 of the European Convention on Human Rights. The first chapter refers to the right to the environment and the definition of noise pollution. Attention was paid to the evolution of the right to the environment, mentioning documents having the greatest impact on its development and the concept of including it in the field of human rights. The topic of noise pollution, its causes, effects and related legal regulations is also discussed. The second chapter deals with the right to respect for private and family life under Article 8 of the European Convention on Human Rights. It relates to its structure, the most important principles of interpretation from an environmental perspective and the categories of obligations derived from it, with particular emphasis on the positive obligations of states. Chapter three is an analysis of the jurisprudence of the European Court of Human Rights on noise pollution and an attempt to determine when, according to the Court, noise violates the right to respect for private and family life.
