Enforcement of mediated settlement agreements under the Singapore Convention

Celem pracy „Wykonywanie ugód mediacyjnych na podstawie Konwencji singapurskiej” jest analiza przepisów Konwencji UNCITRAL o międzynarodowych ugodach pochodzących z mediacji z 2019 roku, która jest jedną z najnowszych umów międzynarodowych w zakresie alternatywnych metod rozwiązywania sporów, w związku z tym nie istnieje jeszcze zbyt wiele opracowań materii w niej zawartej. Założeniem tej pracy jest także ukazanie działalności i roli Komisji ONZ ds. Międzynarodowego prawa handlowego (UNCITRAL) w procesie harmonizacji i unifikacji prawa handlowego w skali globalnej, w tym w szczególności promocji alternatywnych metod rozwiązywania sporów, co w tym opracowaniu ma odzwierciadlenie w mediacji. W pracy została ukazana również geneza powstania Konwencji singapurskiej.W głównej części pracy znajduje się analiza przepisów art. 1-5 i 8 Konwencji, w której omówiona jest szczegółowa kwestia transgranicznej skuteczności ugód zawartych w wyniku mediacji, w tym szczególności jej wykonywania i formalności jakie ugoda powinna spełniać.Ostatnia część stanowi podsumowanie całości opracowania oraz zawiera wnioski autora.

The aim of thesis "Enforcement of mediated settlement agreements under the Singapore Convention" is to analyze the provisions of the United Nations Convention on International Settlement Agreements Resulting from Mediation, which is one of the newest international agreements in the field of alternative dispute resolution, therefore there are not many studies yet in this matter.The assumption of this work is also to show the activity and role of the UN Commission on International Trade Law (UNCITRAL) in the process of harmonization and unification of commercial law on a global scale, including in particular the promotion of alternative dispute resolution methods, which in this study is reflected in mediation. This thesis also shows the genesis of the Singapore Convention.The main part of thesis includes an analysis of the provisions of Art. 3-5 and 8 of the Convention. This part deals in detail with the cross-border effectiveness of settlement agreements resulting from mediation, including in particular its enforcement and the formalities that settlement agreement should meet. The last part is a summary of the thesis and contains the author's conclusions.
