The Ombudsman in protection system of rights and freedoms in Poland

Przedmiotem pracy jest analiza roli Rzecznika Praw Obywatelskich w systemie ochrony praw i wolności w Polsce. Całość składa się ze wstępu i czterech rozdziałów, mających na celu jak najpełniejsze przedstawienie omawianego tematu. Rozdział I skupia się na przedstawieniu pojęcia praw i wolności człowieka. Rozważono także historyczne podejście do praw człowieka, zaprezentowano generacje praw człowieka. Scharakteryzowano system praw człowieka ze względu na jego zasięg terytorialny. Rozdział II ukazuje historię urzędu ombudsmana na świecie wraz z cechami charakterystycznymi dla poszczególnych państw. Przedstawiono uniwersalne cechy ombudsmanów krajowych, jak również wskazano cechy Rzecznika, dzięki którym cieszy się on społecznym zaufaniem. Rozdział III prezentuje genezę instytucji Rzecznika Praw Obywatelskich, tryb powoływania i odwoływania, jak również podmiotowy i przedmiotowy zakres jego działania. W ostatnim rozdziale poruszono kwestię środków działania Rzecznika Praw Obywatelskich; rozważane są środki o charakterze indywidualnym, jak również o charakterze generalnym.

The subject of the thesis is the analysis of the role of theOmbudsman in protection system of rights and freedoms in Poland. Whole thesis consists of an introduction and four chapters which describe related topics in depth. The first chapter concentrates on the definitions of human rights and freedoms, with their respective historical backgrounds and generations and territorial ranges. The second chapter presents the history of the office of ombudsman in the world. It also presents the differences and similarities between countries and unique features that increase social confidence. The third chapter describes the genesis of the institution of the ombudsman, it's correlations with other offices and the mechanism ofappointment and dismissal. It also outlines the scope of actions andindependent discovery proceeding, opening of a proceeding and takingintervention measures. In the last chapter the possible actions, both individual and general, of the ombudsman are described.
