The Influence of the European Union Law on the Constitution and the Jurisdiction of the Constitutional Council of France.

Francja, która jest krajem bardzo przywiązanym do tradycji oraz wartości, jest jednym z krajów założycielskich Wspólnot Europejskich. Członkostwo Francji w Unii Europejskiej nakłada na nią obowiązki wynikające z przyjętych Traktatów oraz prawa UE. W tym kontekście, ważną kwestią jest sprawa suwerenności oraz obawa jej naruszenia przez prawo Unii Europejskiej. Na straży przestrzegania prawa stoi Trybunał Sprawiedliwości Unii Europejskiej w Luksemburgu, który w swoich orzeczeniach dotyczących prawa pierwotnego oraz prawa pochodnego, wskazuje kierunek interpretacji tego prawa. Prawo UE postawiło pod znakiem zapytania miejsce Konstytucji V Republiki w hierarchii źródeł prawa. W orzeczeniach Rada Konstytucyjna wypowiada się co do prawa UE. Orzecznictwo dotyczące rozporządzeń, dyrektyw czy samych traktatów jest bardzo bogate. Nie chcąc przyznać jednoznacznie prymatu prawa UE, Rada stara się dostosowywać Konstytucję V Republiki do wymogów UE tak, by pozostawała najwyższym aktem prawnym w hierarchii źródeł prawa we Francji.

France is a country that is tied to its traditions and values. It is one of the founding countries of the European Communities. The treaties and the law adopted in the European Union impose obligations on France. In this context, there is an important question concerning its sovereignty and the fear of its violation by the European Union law. The Court of Justice of the European Union guards the respect of the EU law. In its rulings on the acts of the primary and the secondary law, the Court shows the direction of the interpretation of this law.EU law has put into question the place of the Constitution of the V Republic in the hierarchy of sources of law. In its decisions, the Constitutional Council speaks about EU law. The jurisdiction relating to regulations, directives and treaties themselves are very rich. Not wanting to admit unequivocally the primacy of EU law, the Council is trying to adapt the Constitution of the V Republic to the EU requirements, so that remains the highest legal act in the hierarchy of sources of law in France.
