The legal basis for the functioning of the professional self-government of the Bar in comparative perspective

Na łamach niniejszej pracy przedstawiona została charakterystyka ustroju samorządu adwokatów w Polsce. Dokonano w niej analizy podstawy prawnej, w oparciu o którą działa polska adwokatura, oraz podjęto próbę oceny, czy w polskim porządku prawnym nie zachodzi konflikt między art. 17 Konstytucji a ustawą - Prawo o adwokaturze. Rozważono także sens istnienia samorządu adwokackiego w jego obecnej formie. Praca zawiera ponadto zestawienie porównawcze samorządu adwokackiego z samorządami radców prawnych i notariuszy.

This thesis was created to give a detailed overwiew over the professional self-government of the Bar in Poland. An attempt was made to analize the legal basis for functioning of the polish professional self-government of the Bar and to to verify whether there is some sort of conflict between the article 17 of the polish Constitution and the Act on the Bar of 26th May 1982 (prawo o adwokaturze). The sense of the existence of the professional self-government of the Bar in its present condition was also put to consideration. Present thesis also contains comparison with two other legal professional self-governments in Poland.
