The crime of genocide and international human rights protection on the example of Rwanda and the former Yugoslavia

W pracy została poruszona problematyka pojęcia ludobójstwa oraz międzynarodowej ochrony praw człowieka. Autorka podejmuje się próby zdefiniowania pojęcia "ludobójstwo" odwołując się do literatury przedmiotu oraz wybranych orzeczeń międzynarodowych trybunałów karnych ad hock definiujących poszczególne elementy ludobójstwa. Na potrzeby rozważań dotyczących zbrodni ludobójstwa, został przedstawiony zarys historyczny ludobójstw popełnionych w Rwandzie i byłej Jugosławii. Wspomniane ludobójstwa posłużyły za studium przypadku w analizie podjętych działań przez organizacje międzynarodowe w celu zapobieżenia, zażegnania i karania zbrodni ludobójstwa. Ponadto autorka przeprowadza analizę międzynarodowego systemu ochrony praw człowieka oraz aktów pranych dotyczących zbrodni ludobójstwa. Na podstawie przeprowadzonych analiz autorka podejmuje się próby oceny podjętych działań przez międzynarodowe organizacje w odniesieniu do popełnionych ludobójstw w Rwandzie i byłej Jugosławii oraz stwierdzenia czy obowiązujący międzynarodowy system ochrony praw człowieka jest skuteczny.

The paper deals with the concept of genocide and the international protection of human rights. The author attempts to define the concept of "genocide" referring to the literature on the subject and selected decisions of international criminal tribunals ad hock defining the various elements of genocide. For the purpose of considering the crime of genocide, a historical overview of the genocides committed in Rwanda and the former Yugoslavia is provided. These genocides served as a case study in analyzing the measures taken by international organizations to prevent, resolve and punish the crime of genocide. In addition, the author conducts an analysis of the international system of human rights protection and the prana acts relating to the crime of genocide. Based on the analysis, the author attempts to evaluate the actions taken by international organizations with regard to the committed genocides in Rwanda and the former Yugoslavia, and to determine whether the existing international system of human rights protection is effective.
