Participation of the prosecutor in administrative procedure

Obecność prokuratora jest istotnym elementem porządku prawnego w Polsce. Prokurator jako uczestnik postępowania stoi na straży legalizmu i jest jego gwarantem. Niniejsza praca została poświęcona temu zagadnieniu. Pierwszy rozdział, będący wstępem do dalszych rozważań, traktuje o tradycji i ewolucji tegoż urzędu, ponadto opisano struktury organizacyjne prokuratury. W drugim rozdziale podniesiono kwestie postępowania administracyjnego - jego strukturę podmiotową. Trzeci rozdział poświęcono uprawnieniom i pozycji prokuratora w postępowaniu administracyjnym. Ponadto w czwartym rozdziale przybliżono podmioty na prawach prokuratora. W konsekwencji praca przedstawia całościową analizę prokuratora jako gwaranta praworządności na gruncie polskim.

The presence of a public prosecutor is an important element of the legal order in Poland. The prosecutor, as a participant in the proceedings, upholds legalism and is its guarantor. This work is devoted to this issue. The first chapter, which is an introduction to further considerations, deals with the tradition and evolution of this office, moreover, the organizational structures of the prosecutor's office are described. The second chapter raises the issues of administrative procedure - its entity structure. The third chapter is devoted to the powers and position of the prosecutor in administrative proceedings. In addition, the fourth chapter presents entities with the rights of a prosecutor. As a consequence, the work presents a comprehensive analysis of the prosecutor as a guarantor of the rule of law in Poland.
