The employer's right to terminate fixed-term contracts of employment by dismissal.

The author presents the problems involving the design and use of fixed-term contracts of employment. In particular, heassesses the scope of protection of workers employed under fixed-term employment contracts in connection with theirtermination by dismissal by the employer. The scope of the flexibility of these contracts is evaluated in the context ofbalancing the legitimate interests of employers and the employee protection principle, standards of the Europeanemployment law, compliance with the Constitution of the Republic of Poland, the efficiency of the labour market. Theauthor concludes that the protection against dismissal of workers employed under fixed-term contracts of employmentshould be increased.

W szczególności oceniazakres ochrony pracowników zatrudnionych na podstawie terminowych umów o pracę w związku z możliwością ichwypowiedzenia przez pracodawcę. Zakres elastyczności poszczególnych umów jest oceniany w kontekście wyważeniasłusznych interesów pracodawcy i zasady ochrony pracownika, standardów europejskiego prawa pracy, zgodności zKonstytucją RP, efektywnością rynku pracy. Autor dochodzi do wniosku, że ochrona przed wypowiedzeniem umów opracę pracownikom terminowym powinna zostać poszerzona.
