The meaning of the energy solidarity principle for guaranting energy security in the European Union, with special regard to ensure security of supply of gas and oil

The theme of this thesis is the energy solidarity principle and its role in protecting energy security in the European Union. The subject was limited to one particular element consisting of energy security. It is the security of supply of energy resources: oil and gas which are consumed as a major sources of energy in the European Union and the world. To understand what is the energy solidarity at the beginning of this study the general solidarity principle was analyzed through the prism of its definition and process of its formation in ideology, politics and law of the European Union. Then the current energy situation in the European Union was outlined and issue of energy security and its threats was explained. The next chapter presents the issue of energy solidarity principle which emerges from the numerous legal acts and documents of EU institutions with the Treaty of Lisbon at the head. The last chapter of this thesis addresses the issue of legal protection of this principle taking into consideration the possibility of derivation of specific rights and obligations of it before the courts of the European Union based on the complaints of the articles 258, 259 and 165 TFEU.

Tematem niniejszej pracy jest zasada solidarności energetycznej i jej rola w ochronie bezpieczeństwa energetycznego w Unii Europejskiej. Przedmiot rozważań ograniczono do jednego konkretnego elementu składającego się na bezpieczeństwo energetyczne. Jest nim bezpieczeństwo dostaw surowców energetycznych: gazu i ropy naftowej, czyli dwóch najważniejszych, bo cieszących się największym zużyciem w Unii Europejskiej, źródeł energii. Aby zrozumieć czym jest owa solidarność energetyczna w niniejszej pracy poddano analizie w pierwszej kolejności samą zasadę solidarności w Unii Europejskiej, jej definicję oraz proces jej kształtowania w ideologii, polityce i prawie Unii Europejskiej. Następnie została zarysowana sytuacja energetyczna, w jakiej obecnie znajduje się Unia, a także wyjaśniono na czym polega bezpieczeństwo energetyczne, szczególną uwagę poświęcając bezpieczeństwu dostaw gazu i ropy naftowej. W kolejnym rozdziale przedstawiono obraz solidarności energetycznej jaki wyłania się z licznych aktów prawnych i dokumentów instytucji unijnych z Traktatem z Lizbony na czele. W ostatnim rozdziale niniejszej pracy poruszono kwestię ochrony prawnej tej zasady, poddając pod rozwagę możliwość wywodzenia z niej konkretnych praw i obowiązków przed sądami Unii Europejskiej na podstawie skarg z art. 258, 259 i 265 TFUE.
