Implementation of the administrative decision

Przedmiotem pracy magisterskiej jest analiza pojęcia wykonalności decyzji administracyjnej na płaszczyźnie przepisów prawa administracyjnego materialnego, procesowego jak również wypowiedzi przedstawicieli doktryny. Praca została podzielona na pięć rozdziałów, w których zostały wskazane podstawowe pojęcia związane zarówno z decyzją administracyjną i jej elementami, klauzulą ostateczności oraz rygorem natychmiastowej wykonalności. Przedstawiona tematyka jest szczególnie istotna zarówno dla organów prowadzących postępowania administracyjne w obszarze prawa budowlanego oraz prawa podatkowego jak również stron w nich uczestniczących. Powyższe zagadnienia przysparzają wiele praktycznych problemów, które oscylują wokół możliwości wstrzymania wykonania decyzji administracyjnej i wzajemnej relacji pomiędzy organem i sądem administracyjnym w tym procesie. Sama kwestia dotycząca udzielenia ochrony tymczasowej wynikająca z art. 61 § 3 p.p.s.a została szczegółowa omówiona z uwzględnieniem stanowiska doktryny w tym zakresie oraz orzecznictwa. W przedmiotowej pracy uwzględniono możliwość zastosowania powyższej instytucji na podstawie przepisów wynikających z ustaw szczególnych.

The subject of the master's thesis is the analysis of the concept of the enforceability of an administrative decision at the level of substantive and procedural administrative law as well as statements of representatives of the doctrine. The work was divided into five chapters in which the basic concepts related to both were indicated with the administrative decision and its elements, the final clause and the order of immediate enforceability. The subject matter presented is particularly important for both for authorities conducting administrative proceedings in the area of ​​construction law and tax law, as well as parties participating in them. The above-mentioned issues cause many practical problems, which oscillate around the possibility of suspending the execution of an administrative decision and the mutual relationship between the authority and the administrative court in this process. The very issue of granting temporary protection arising from art. 61 § 3 of the p.p.s.a. has been discussed in detail, taking into account the position of the doctrine in this resulting respect and the jurisprudence. The present study takes into account the possibility of applying the above-mentioned institution on the basis of provisions from specific acts.
