Tłumaczenie Kodeksu Spółek Handlowych - między językiem a prawem. Ekwiwalencja w tłumaczeniu prawnym.

Code of Commercial Companies in translation - between language and law. Equivalence in legal translation.

Praca poświęcona jest analizie tłumaczeń obowiązującego w polskim systemie prawnym kodeksu spółek handlowych.Pierwszy rozdział przedstawia problemy języków specjalistycznych, a zwłaszcza języka prawnego. Stanowi on próbę opisu jego natury, charakteru społecznego i normatywnego oraz najważniejszych cech stylistycznych, terminologicznych, morfologicznych. Drugi rozdział koncentruje się wokół zjawiska wzajemnych wpływów języka i kultury. Analizuje odbicie kultury w językach specjalistycznych oraz w tłumaczeniu prawnym, a w dalszej części prezentuje najważniejsze problemy tłumaczenia między różnymi systemami prawnymi. Ostatni rozdział części teoretycznej porusza problem ekwiwalencji (historię pojęcia, jej poziomy i stopnie) ze szczególnym uwzględnieniem ekwiwalencji funkcjonalnej.W części praktycznej pracy przeanalizowano dwa tłumaczenia na j. francuski polskiego kodeksu spółek handlowych, którego przepisy ogólne posłużyły za korpus pracy. Bazując na słownikach dwujęzycznych oraz specjalistycznych, a przede wszystkim na tekstach francuskich kodeksów starano się w nim znaleźć wyjaśnienie dla konkretnych wyborów dokonywanych przez tłumaczy. Przeprowadzona analiza pozwoliła na sformułowanie wniosków co do specyfiki pracy tłumacza tekstów prawnych i stojących przed nim wyzwań.Praca kończy się aneksem, w którym zamieszczono teksty dwóch analizowanych tłumaczeń.

The goal of this dissertation is to analyze translations of the Code of Commercial Companies which is in force in Polish legal system. The first chapter discusses the difficulties met while dealing with specialized languages, especially with legal language. The attempt is made to describe its nature, its social and normative character, as well as the main stylistic, terminological and morphological features.The second chapter focuses on mutual influences between the language and the culture. It examines the reflections of culture in legal terms of specialized languages and in legal translation. Further, the chapter presents major problems of translation from one legal system to another.The last chapter of the theoretical part touches the problem of equivalence (the history of the term, its levels and degrees), with particular emphasis put on functional equivalence.In the practical part of the dissertation, two translations of Polish Code of Commercial Companies into French were analyzed and the general regulations of the Code were used as a body of work.Basing on specialized and bilingual dictionaries and above all on the texts of French codes, the attempt was undertaken to find explanations for the concrete choices made by the translators.The analysis allowed to formulate some conclusions concerning the specificity of work of a legal texts' translator and the challenges he faces.The dissertation ends with an annex, consisting of the texts of two translations analyzed.

Le but de ce travail est d’analyser deux traductions du Code des sociétés commerciales, qui est en vigeur dans le système juridique polonais. Le premier chapitre est consacré aux problèmes des langues spécialisées, en particulier du langage juridique. Nous y essayons de décrire sa nature, son caractère social et normatif, et ses traits linguistiques les plus importants - stylistiques, terminologiques, morphologiques.Dans le deuxième chapitre, nous nous concentrons sur les problèmes d’influence mutuelle de la langue et de la culture. Nous analysons l’empreinte culturelle dans les langues spécialisées et dans la traduction juridique, pour présenter ensuite des défis majeurs de la traduction entre différents systèmes juridiques. Le dernier chapitre de notre partie théorique concerne la question d’équivalence (l’histoire de la notion, ses niveaux, degrés), et notamment l’équivalence fonctionnelle.Dans notre partie pratique, nous avons analysé deux traductions en français du Code des sociétés commerciales polonais, dont les dispositions générales nous ont servi de corpus. En consultant les dictionnaires bilingues et spécialisés, nous avons cherché à justifier les choix des traducteurs.Cet analyse nous a permis de formuler les conclusions concernant la spécificité du travail de traducteur juridique et les défis qui lui sont quotidiennement posés.Notre mémoire de maîtrise finit par l’annexe qui contient les textes des deux traductions analysées.
