Justification of the administrative decision on the basis of selected general principles of administrative procedure

Niniejsza praca przedstawia uzasadnienie decyzji administracyjnej na gruncie wybranych zasad ogólnych postępowania administracyjnego. Instytucja uzasadnienia zasługuje na szczególną uwagę, bowiem stanowi formę realizacji wybranych zasad ogólnych. W związku z powyższym, element uzasadnienia jest niezwykle istotny dla adresata aktu (co wskazuje w głównej mierze niniejsza praca), organu go formułującego, ale także sądu administracyjnego, dokonującego kontroli legalności na skutek zaskarżenia aktu.Praca składa się z trzech rozdziałów. Rozdział pierwszy zawiera charakterystykę decyzji administracyjnej, mianowicie wskazane zostały prócz samego pojęcia decyzji, jej aspekty, cechy, zawartość, a także rodzaje. Ponadto, w rozdziale tym została przedstawiona również charakterystyka najważniejszych, z perspektywy uzasadnienia, zasad ogólnych postępowania administracyjnego. W rozdziale drugim znajdują się natomiast informacje, pozwalające na zgłębienie wiedzy na temat wszechstronnej roli, jaką odgrywa uzasadnienie oraz jego znaczenie wobec różnych podmiotów. Co więcej, kwestia wspomnianej wyżej realizacji zasad ogólnych poprzez instytucję uzasadnienia została także omówiona w przytoczonym rozdziale. Ostatni podrozdział opisuje zaś możliwość zaskarżenia uzasadnienia.Rozdział trzeci prezentuje uzasadnienie z punktu widzenia Naczelnych oraz Wojewódzkich Sądów Administracyjnych. Sądy wyznaczają przede wszystkim funkcje uzasadnienia, odnosząc się najczęściej do zasad: praworządności, przekonywania, informowania oraz zaufania do władzy publicznej. Dodatkowo we wskazanym rozdziale omówione zostały przypadki, w których powyższe zasady zostały naruszone, co w konsekwencji doprowadziło do uchylenia decyzji administracyjnej.

This bachelor's thesis presents justification in the context of selected general principles of administrative procedure. The institution of justification deserves special attention, because it is a form of implementation of selected general principles. Due to the above, the element of justification is extremely important for the recipient of the act, the person who formulates it, but also for the administrative court reviewing the legality as a result of challenging the act.The bachelor's thesis consists of three chapters. The first chapter contains the characteristics of an administrative decision, including definitions of the decision, aspects, features, contents and types. Moreover, this chapter also presents the characteristics of the most important general principles of administrative procedure from the perspective of justification.The second chapter provides information allowing for deepen knowledge about the comprehensive role of justification and its importance towards various entities. What is more the issue of the above mentioned implementation of general principles trough the institution of justification was also discussed in the cited chapter. The last subsection describes the possibility of appealing against the justification.The third chapter presents the justification from the point of view of the administrative courts. Courts primarily determine the functions of justification, most often reffering to the principles of: the rule of law, persuasion, information and trust in public authorities. Additionally, the chapter discusses cases in which the above rules were violated, which consequently led to the repeal of the administrative decision.
