Illegal strike

Praca ta porusza tematykę strajków sprzecznych z prawem, które określane są strajkami nielegalnymi. Ocena strajków pod względem zgodności z prawem została dokonana w oparciu o obowiązującą ustawę o rozwiązywaniu sporów zbiorowych, Konstytucję RP oraz wiążące Polskę umowy międzynarodowe. Autorka porusza tematykę prawa do strajku, szczegółowej ocenie poddano art. 1 ustawy o rozwiązaniu sporów zbiorowych, który wskazuje przedmiotowe przesłanki legalnego strajku. Ponadto w pracy omówiono proceduralne oraz podmiotowe warunki legalnych strajków. Poruszona została również kwestia odpowiedzialności za kierowanie lub zorganizowanie nielegalnego strajku oraz uczestnictwo w takim strajku. Podsumowując autor zauważa, że obecna ustawa wymaga dostosowania do wiążących Polskę umów międzynarodowych.

The subject of my thesis is the problems strike in violation of the law which called is illegal strike. The strike is evaluated in context of the Constitution of the Republic of Poland and the Act of 23 May 1991 on Collective Labour Dispute Resolution compliance with the standards of the European employment law .The author discussed topics such as right to strike, purpose of legall strike, which is referred in the art. 1 of 1991. In separate chapters were discussed who can call a stirke.Master thesis presents also procedural aspects of illegal strike,liability for action and attend in illegal strike. The author concludes that the rules of organizaton strike should be more conform to international law.
