Appointment of judges of the Constitutional Court in Poland

Przedmiotem pracy jest problematyka związana z powoływaniem sędziów Trybunału Konstytucyjnego w Polsce. W pierwszej kolejności w pracy zostało przedstawione w ujęciu porównawczym jak funkcjonuje powoływanie sędziów Trybunału w innych krajach Europy. Przez pryzmat tej analizy dokonano charakterystyki polskich rozwiązań zarówno konstytucyjnych jaki i ustawowych. W pracy dokonano również analizy procesu dokonywania wyboru sędziów Trybunału przez Sejm począwszy od 1985 roku aż do 2017. Istotnym elementem była też próba scharakteryzowania sporu konstytucyjnego powstałego w 2015 roku w Polsce wokół wyboru sędziów Trybunału Konstytucyjnego. Przedstawiono także pojawiające się propozycje przedstawicieli nauki i partii politycznych dotyczące zmian właśnie w zakresie wyboru sędziów Trybunału (także zgłaszanych w celu zakończenia powyższego sporu konstytucyjnego). W pracy przyjęto metodę formalno-dogmatyczną opierając się na aktach prawnych dotyczących trybunału konstytucyjnego, ale również dokonano opisu działalności sejmu poprzez analizę jego posiedzeń i dokumentów umieszczonych na stronie Sejmu.

The subject of the work is the issues connected with appointing judges of the Constitutional Tribunal in Poland. In the first place, the work is presented in a comparative perspective how the judges of the Court in other European countries function. The characteristics of Polish constitutional and statutory solutions have been characterized in this analysis. The work also analyzes the process of selecting judges of the Tribunal by the Sejm from 1985 until 2017. An important element was also an attempt to characterize the constitutional dispute created in 2015 in Poland around the selection of judges of the Constitutional Tribunal. The proposals of representatives of science and political parties on the changes in the choice of judges of the Tribunal (also reported to complete the above constitutional dispute) are also presented. The paper adopts the formal-dogmatic method based on the legal acts concerning the constitutional court, but also describes the activity of the parliament by analyzing its meetings and documents placed on the website of the Sejm.
