Parliamentary commission of inquiry - constitutional position and organization of work

Tematem pracy jest instytucja sejmowej komisji śledczej, jej pozycja ustrojowa oraz organizacja pracy. Zaprezentowane zostały czynniki zasadniczo wypływające na pozycję komisji, w ujęciu porównawczym do pozostałych organów wewnętrznych Sejmu oraz rozwiązania przyjęte przez ustawodawcę kształtujące organizację. W szczególności dokonano analizy komisji stałych, jako parlamentarnego organu pomocniczego, w celu ukazania różnic między tymi dwoma instytucjami oraz wyszczególnienia dzięki temu wyjątkowości charakteru komisji śledczej.Na podstawie zestawienia dotychczas powołanych komisji oraz w oparciu o orzecznictwo, ustawodawstwo i pozostałe przeprowadzone w literaturze analizy, zostały zaprezentowane główne cechy instytucji, w szczególności skupiając się na charakterze konstytucyjnie niedookreślonej ‘’sprawy’’. Pozwoliło to wyartykułować jedną z ważniejszych cech komisji, jaką jest jej ‘’określoność’’ – zrozumiałe, konsekwentne i dokładne określenie rozwiązywanego problemu.Istotnym elementem pracy było podkreślenie rangi instytucji, która w przeciwieństwie do innych kompetencji kontrolnych sejmu, posiada o wiele szerszy zakres działania. Szczegółowo przeanalizowano kwestie odnoszące się do zasad powołania komisji sejmowych wraz z procedurami, które muszą zostać podjęte. Przybliżony został jej skład osobowy z towarzyszącymi temu zagadnieniu przesłankami oraz kierownictwo, znajdujące w kognicji przewodniczącego komisji śledczej i/lub jego zastępcy (zastępców). Przywołane zostały ustawowe kompetencje przewodniczącego, a także zagadnienie przeniesienia tych zdolności na innych członków składu.

The subject of thesis is the institution of the Parliamentary commission of inquiry, its constitutional position and the organization of its work. The factors fundamentally influencing the position of the commission are presented, in comparative terms to the other internal parts of the Parliament, as well as the solutions adopted by the legislator shaping the organization. In particular, the standing committees, as a parliamentary auxiliary body, were analyzed in order to show the differences between the two institutions and to detail, the uniqueness nature of the investigative committee.On the basis of a compilation of the commissions established to date, as well as on the basis of case law, legislation and other analyses carried out in the literature, the main features of the institution were presented, particularly focusing on the constitutionally undefined ''case.'' This made it possible to articulate one of the most important features of the commission, which is its ''definiteness'' - the comprehensible, consistent and precise definition of the problem being solved.An important element of the work was to emphasize the importance of the institution, which, unlike other control powers of the parliament, has a much broader scope of action.Issues relating to the principles of establishing parliamentary committees, along with the procedures that must be undertaken, are examined in detail. Its composition, with the accompanying rationale, and the leadership, which is within the cognizance of the chairman of the investigative committee and/or his deputy(s), are outlined. The statutory powers of the chairman are recalled, as well as the issue of transferring these abilities to other members of the composition.
