Measures taken against maintenance debtors according to the Act of the 7th of September 2007 in aid of persons entitled to the maintenance support

Praca licencjacka pt: ,,Działania podejmowane wobec dłużników alimentacyjnych na podstawie ustawy z dnia 7 września 2007 r. o pomocy osobom uprawnionym do alimentów" przedstawia opis czynności, jakie organ dokonuje wobec osób uchylających się od obowiązku alimentacyjnego. W celu ukazania złożoności tych działań, w pracy uwzględniono m. in. postępowanie w celu przymuszenie dłużnika do zapłaty alimentów, opis przyczyn, dla których organ administracyjny wydaje decyzję o uznaniu dłużnika za uchylającego się od zobowiązań alimentacyjnych oraz opis skutków takiej decyzji. Jako że postępowanie administracyjne jest dwuinstancyjne, w pracy zostało również odtworzone postępowanie odwoławcze. Innym równie istotnym tematem zawartym w pracy jest status dłużnika alimentacyjnego w postępowaniu o przyznanie świadczeń z funduszu alimentacyjnego, w którym nierzadko powstają problemy z interpretacją określonych przepisów. Przedstawione zagadnienie związane z działaniami podejmowanymi wobec dłużnika alimentacyjnego ukazuje jak wysoce jest ono skomplikowane. Czytając przepisy, zamieszczone w ustawie o pomocy osobom uprawnionym do alimentów i w kodeksie postępowania administracyjnego można dojść do wniosku, iż nie jest ono specjalnie trudne, jednak praktyka mówi zupełnie co innego.

Dissertation project named ”Measures taken against maintenance debtors according to the Act of the 7th of September 2007 in aid of persons entitled to the maintenance support” presents the description of operations which an authority performs against persons who deviate from their maintenance obligations. In order to demonstrate the complexity of these operations, the project incorporated, among others: the procedure for pressuring the debtor to pay the child support, the description of reasons for which an administrative authority issues a decision to acknowledge the debtor of repealing the maintenance obligations and the description of consequences of such a decision. Since the administrative procedure in Poland consists of two instances, the dissertation reproduces also the appeal proceedings. Another significant topic considered in the paper is the position of a maintenance debtor in the procedure for grant allowances from the Child Maintenance Fund, where problems with a proper interpretation of certain regulations are not uncommon. The elaboration of the issue regarding the actions taken against maintenance debtors displays how highly intricate is the problem. The lecture of the regulations that can be found in the act in aid of persons entitled to the maintenance support, as well as in the Code of administrative procedures, may lead to a conclusion that these regulations are not troublesome, yet the experience shows the opposite.
