Ethical and legal problems related to abortion and surrogacy in Poland and Ukraine. Mutual Correlations

Temat niniejszej pracy jest „Problemy etyczno-prawne dotyczące aborcji oraz macierzyństwa zastępczego w Polsce i w Ukrainie. Wzajemne korelacje.” Na przykładzie wybranych dwóch problemów aborcji w Polsce i macierzyństwo zastępczego w Ukrainie badano obecność obywateli dwóch różnych krajów w ich życiu. Ta obecność wynika jako skutek zakazu aborcji w Polsce i rozpowszechniania zjawiska aborcyjnego turyzmu do Ukrainy. A obecność Ukrainek wynika z tego, że one często stają się matkami zastępczymi dla polskich rodzin. Żeby całościowo spojrzeć na ten problem badawczy w pierwszym rozdziale analizowano problem aborcji i macierzyństwa zastępczego z filozoficznego i etycznego punktu widzenia. Opisano poglądy różnych badaczy na pytania od którego momentu zaczyna się życie? Opisano także poglądy czy macierzyństwo zastępcze jest „handlem ciałem kobiety”, „handlem dziećmi „ czy pomoc w otrzymaniu prawa do ojcostwa. Rozdział drugi pod tytułem „Ogólna analiza regulacji prawnej wybranych problemów” dotyczy regulowaniu wybranych problemów na poziomie prawnym w tej części zbadano akty prawne, który zajmują się regulacją aborcji i surogacji. Rozdział ten składa się z 4 podrozdziałów. W trzecim rozdziale pod tytułem „Zakaz aborcji w Polsce i jego konsekwencje” proanalizowano do czego doprowadziło orzeczenie TK o zakazie aborcji i jakie negatywne skutki mają miejsce. Opisano wzrost liczby nielegalnej aborcji i zjawiska turystyki aborcyjnej do Ukrainy. Oprócz tego uwzględniono nowy problem, który pojawił się w związku z wojną w Ukrainie, a mianowicie, problem obywatelek Ukrainy, które były wykorzystywani seksualnie przez rosyjskich żołnierzów i zeszły w ciążę i obecnie znajdują się na terytorium RP jako uchodźcy i nie mają dostępu do aborcji.W rozdziale czwartym pod tytułem „Macierzyństwo zastępcze w Ukrainie i związane z nim problemy ”zbadane problemy z którymi spotykają się ukraińskie matki zastępcze i polskie rodziny, które korzystają z usług macierzyństwa zastępczego i jak wpłynęła na te relacje wojna. W rozdziale piątym opisano stosunek Kościoła i Cerkwi do macierzyństwa zastępczego i aborcji.

The topic of this work is „Ethical and legal problems related to abortion and surrogacy in Poland and Ukraine. Mutual Correlations.” On the example of two selected problems of abortion in Poland and surrogate motherhood in Ukraine, the presence of citizens of two different countries in their lives was examined. This presence results from the ban on abortion in Poland and the spread of the phenomenon of abortion tourism to Ukraine. And the presence of Ukrainian women results from the fact that they often become surrogate mothers for Polish families.To comprehensively look at this research problem, the first chapter analyzes the problem of abortion and surrogacy from a philosophical and ethical point of view. The views of various researchers were described on the questions from what point does life begin? Views were also described as to whether surrogacy is “trafficking in a woman's body”, “trafficking in children” or assistance in obtaining the right to paternity.The second chapter entitled “General analysis of the legal regulation of selected problems” concerns the regulation of selected problems at the legal level, in this part the legal acts dealing with the regulation of abortion and surrogacy are examined. This chapter consists of 4 subsections.In the third chapter, entitled “The ban on abortion in Poland and its consequences”, we analyzed pro-what led to the ruling of the Constitutional Tribunal on the prohibition of abortion and what negative effects are taking place. The increase in the number of illegal abortions and the phenomenon of abortion tourism to Ukraine are described. In addition, a new problem that arose in connection with the war in Ukraine was taken into account, namely the problem of Ukrainian women who were sexually abused by Russian soldiers and became pregnant and are now on the territory of the Republic of Poland as refugees and have no access to abortions.In the fourth chapter, “Surrogate motherhood in Ukraine and related problems”, the problems faced by Ukrainian foster mothers and Polish families who use surrogate motherhood services are examined and how these relations were affected by the war.The fifth chapter describes the attitude of the Church towards surrogacy and abortion.
