Pornography issue in criminal law.

W pracy poddane analizie zostało zjawisko pornografii i prawnokarna regulacja omawianej tematyki. Poruszono problematyczną kwestię związaną ze znamieniem treści pornograficznych i wykazano podejmowane próby definicyjne. W pracy ukazano historyczny przekrój podejścia do tematyki pornografii i wskazano przyjęte rozwiązania na przestrzeni lat. Omówione zostały również rozwiązania przyjęte na gruncie międzynarodowym oraz europejskim. Dokonano dogmatycznej analizy uregulowania z artykułu 202 Kodeksu karnego z 1997 roku wraz ze wskazaniem poszczególnych kwestii problemowych. Zwrócono uwagę na kwestię pornografii dziecięcej oraz pornografii pseudo dziecięcej. Omówiona została także problematyka związana z postępującą technologią i zjawiskiem tzw. deepfake w kontekście produkcji pornograficznych.

This paper describes the issue of pornography, attempts to firmly describe this phenomenon and the criminal law regulations regarding it. Within the paper one can find descriptions of issues stemming from creation, distribution and consuming of pornographic content over the years as well as all the attempts to regulate this issue. The work also attempts to present the approach towards pornography across history and describes the solutions adopted over the years. Both international and European laws are discussed. The paper also contains a thorough analysis of the regulations of Article 202 of the polish criminal code from 1997 along with indication of all the issues that are still unresolved within the context of this regulations. The paper also raises the problem of child and pseudo child pornography as well as all the issues stemming from technological advancement such as deepfake phenomenon.
