Prison overcrowding in Poland in the years 1990-2017

Celem pracy jest omówienie problemu przeludnienia więziennego w Polsce w latach 1990-2017. W niniejszej pracy na wstępie przedstawiono rys historyczny omawianego problemu oraz problemy definicyjne związane z właściwym ujęciem przeludnienia więziennego. Następnie dokonano przeglądu statusu prawnego osób uwięzionych ze szczególnym uwzględnieniem prawa do powierzchni mieszkalnej osób pozbawionych wolności oraz przepisów regulujących tę materię w kodeksie karnym wykonawczym. W kolejnym rozdziale zaprezentowano przyczyny przeludnienia więzień w Polsce, politykę kryminalną państwa i jej wpływ na populację więzienną oraz strukturę kar orzekanych w Polsce. Rozdział IV opisuje skutki przeludnienia więziennego oraz wiążące się z nim koszty takie jak: negatywny wpływ przeludnienia więziennego w aspekcie psychologicznym, problem wypalenia zawodowego kadry penitencjarnej, ograniczenie efektywności oddziaływania penitencjarnego, zagrożenia epidemiologiczne, zagrożenia dla bezpieczeństwa osobistego osób pozbawionych wolności. Na koniec rozdziału zaprezentowano rozwiązania umożliwiające zapobieganie negatywnym skutkom przeludnienia więziennego.

The aim of the study is to discuss the problem of prison overcrowding in Poland in the years 1990-2017. In this paper, at the beginning, a historical outline of the discussed problem and the definition problems related to the proper approach to prison overcrowding are presented. Then the legal status of imprisoned persons was reviewed, with particular emphasis on the right to a living space of persons deprived of liberty and the provisions regulating this matter in the Executive Penal Code. The next chapter presents the causes of overcrowding in prisons in Poland, the criminal policy of the state and its impact on the prison population, and the structure of penalties imposed in Poland. Chapter IV describes the effects of prison overcrowding and the associated costs, such as: the negative psychological impact of prison overcrowding, the problem of occupational burnout of penitentiary staff, limiting the effectiveness of penitentiary impact, epidemiological threats, threats to the personal safety of persons deprived of liberty. At the end of the chapter, solutions for preventing the negative effects of prison overcrowding are presented.
