dc.abstract.enThis master’s thesis presents the development of the biodiversity conservation and its relation to the patent protection. The issues concerning the justification of protection of the biological diversity were discussed in the first part of this work, with particular emphasis on the relation to the patent protection. Then was explained the concept and the definition of the biodiversity and traditional knowledge, and there were presented proposed various legal ways to protect biodiversity provided under the international law (Convention on Biological Diversity, signed in Rio de Janeiro on 5 June, 1992; the Cartagena Protocol on Biosafety to the Convention on Biological Diversity, 29 January, 2000; and Nagoya Protocol on Access to Genetic Resources and the Fair Equitable Sharing of Benefits Arising, 29 October, 2010), and selected regional and national solutions ( in Peru, Costa Rica, India and Brazil). National legislation were chosen in view of the following issues. Firstly, these countries are very rich in biodiversity. Secondly, they provide under their regulations the sui generis protection of biodiversity as well as the access to genetic resources. Thirdly, they are parties of the Agreement on Trade-Related Aspects of Intellectual Property Rights, 15 April, 1994 (TRIPS Agreement). The sui generis protection of genetic resources was discussed extensively. The issue of the biodiversity conservation is particularly associated with the protection of traditional knowledge. On account of this the Convention on Biodiversity also focuses on those aspects. Therefore this master’s thesis discusses some issues of border protection of genetic resources and associated traditional knowledge protection issues. Moreover it presents the problem of violations of the existing system of the protection of the biodiversity and access to genetic resources, namely the nodal issues concerning the biological piracy. In the following paper were presented the theories of the introduction and maintenance of patent protection and biotechnological inventions which operation may serve the protection biodiversity, but may also constitutes a risk and violates the principle of the sui generis protection of the biodiversity and the system of access to genetic resources. Hence the regulation of the patent law was presented, especially combined with biotechnology inventions (the Paris Convention for the Protection of Industrial Property, 20 March, 1883, Paris; the TRIPS Agreement; the Convention on the Grant of European Patents, 5 October, 1973, Munich; directive 98/44/EC of the European Parliament and of the Council of 6 July,1998 on the legal protection of biotechnological inventions; the polish Industrial Property Act of 30 June, 2000). The last (fourth) part of the master’s thesis presents issue of the relationship between the biodiversity and the protection system of the patent protection. It is also focused on the effectiveness of existing regulations for the protection of the biodiversity. The possibility of the harmonization of the present regulations and propositions of the future regulations were also analyzed in the last part of the master’s thesis.pl
dc.abstract.plNiniejsza praca magisterska jest opracowaniem tematyki ochrony różnorodności biologicznej oraz jej relacji do ochrony patentowej. W pierwszej części pracy zostały omówione zagadnienia dotyczące uzasadnienia ochrony różnorodności biologicznej, ze szczególnym uwzględnieniem relacji do ochrony patentowej. Następnie wyjaśniono pojęcia bioróżnorodności oraz wiedzy tradycyjnej, a także zaprezentowano proponowane w różnych porządkach prawnych sposoby ochrony bioróżnorodności zgodnie z prawem międzynarodowym (m.in. Konwencją o różnorodności biologicznej, sporządzoną w Rio de Janeiro dnia 5 czerwca 1992 r.; Protokołem z Kartageny o bezpieczeństwie biologicznym do Konwencji o różnorodności biologicznej z dnia 29 stycznia 2000 roku; Protokołem z Nagoi z dnia 29 października 2010 r. o dostępie do zasobów genetycznych oraz sprawiedliwym i równym podziale korzyści wynikających z wykorzystania tych zasobów) oraz wybranymi rozwiązaniami regionalnymi i krajowymi (Peru, Kostaryki, Indii i Brazylii). Dobór prezentowanych w pracy rozwiązań krajowych jest uzasadniony: po pierwsze, występowaniem w tych krajach bardzo bogatej różnorodności biologicznej; po drugie, wprowadzeniem na ich terytorium ochrony sui generis bioróżnorodności oraz regulacji w zakresie dostępu do zasobów genetycznych; po trzecie, związaniu postanowieniami Porozumienia w sprawie handlowych aspektów praw własności intelektualnej z dnia 15 kwietnia 1994 roku (porozumienia TRIPS). W sposób najszerszy przedstawiono tematykę ochrony sui generis zasobów genetycznych. Problematyka ochrony różnorodności biologicznej jest w sposób szczególny związana z ochroną wiedzy tradycyjnej. Także Konwencja o bioróżnorodności skupia na tych aspektach swoją uwagę. Stąd w niniejszej pracy omówiono niektóre zagadnienia z pogranicza ochrony zasobów genetycznych i związanych z nimi zagadnień ochrony wiedzy tradycyjnej. W tej części przedstawiono także problematykę naruszeń istniejącego systemu ochrony bioróżnorodności oraz dostępu do zasobów genetycznych, tj. zaprezentowano węzłowe zagadnienia dotyczące piractwa biologicznego. W dalszej części pracy zaprezentowano teorie przemawiające za wprowadzeniem i utrzymywaniem ochrony patentowej oraz poruszono problematykę wynalazków biotechnologicznych powstałych przy wykorzystaniu materiału biologicznego, a których eksploatacja może służyć ochronie bioróżnorodności, ale może także stanowić dla niej zagrożenie oraz naruszać zasady systemu sui generis ochrony bioróżnorodności oraz dostępu do zasobów genetycznych. Stąd przedstawiono regulacje, które normują ochronę patentową, tym wynalazków biotechnologicznych (Konwencję Paryska o ochronie własności przemysłowej, zatwierdzoną dnia 20 marca 1883 r. w Paryżu; porozumienie TRIPS; Konwencję o udzielaniu patentów europejskich sporządzoną dnia 5 października 1973 r. (z późniejszymi zmianami) w Monachium; dyrektywę Parlamentu Europejskiego i Rady 98/44/WE z dnia 6 lipca 1998 r. w sprawie ochrony prawnej wynalazków biotechnologicznych; ustawę z dnia 30 czerwca 2000 r. – Prawo własności przemysłowej). W ostatniej (czwartej) części pracy dokonano oceny relacji systemu ochrony bioróżnorodności oraz ochrony patentowej oraz skuteczności istniejących regulacji dla ochrony bioróżnorodności. Poddano także analizie możliwość uzgodnienia istniejących regulacji, a także wskazano uwagi legislacyjne na przyszłość.pl
