Praca została poświęcona rozważaniom na temat pozycji ustrojowej, funkcji oraz zadań najwyższego przedstawiciela Rzeczypospolitej Polskiej, którym jest Prezydent RP.Rozważania obejmują w głównej mierze wykładnie art. 126 Konstytucji RP, który rozpoczyna V rozdział ustawy zasadniczej w całości poświęcony Prezydentowi RP. Pierwszy rozdział pracy dotyczy pozycji ustrojowej głowy państwa przez pryzmat jednej z najstarszych zasad towarzyszących rozwojowi myśli ustrojowej uwzględnionej przez III Rzeczpospolitą - zasadę podziału władz. Określimy model prezydentury omawiając legitymację oraz podstawowe zasady jej towarzyszące.W rozdziale drugim przede wszystkim odpowiemy na pytanie co oznacza pojęcie „funkcji” Prezydenta a następnie przeanalizujemy art. 126 ust. 1, który owe funkcje wyznacza. Dowiemy się co wynika z „najwyższego przedstawicielstwa Rzeczypospolitej Polskiej” i jakie znaczenie praktyczne ma funkcja „gwaranta ciągłości władzy państwowej.W rozdziale trzecim rozwiniemy wskazane w art. 126 ust. 2 zadania Prezydenta RP tj. „czuwanie nad przestrzeganiem Konstytucji”, „stanie na straży suwerenności i bezpieczeństwa państwa” a także „stanie na straży nienaruszalności i niepodzielności jego terytorium”. Uwzględnimy relację głowy państwa z radą ministrów, problematykę sporu kompetencyjnego oraz zasady współdziałania. Rozważania dotyczą ogólnej charakterystyki funkcji i zadań Prezydenta RP bez omawiania przydzielonych konstytucyjnie i ustawowo kompetencji.

The work is devoted to the consideration of the constitutional position, functions and tasks of the highest representative of the Republic of Poland, which is the President of the Republic of Poland.The considerations mainly include the interpretation of Article 126 of the Constitution of the Republic of Poland, which begins Chapter V of the Basic Law entirely devoted to the President of the Republic of Poland.The first chapter of the work deals with the constitutional position of the head of state through the prism of one of the oldest principles accompanying the development of political thought considered by the Third Republic - the principle of separation of powers. We will define the model of the presidency by discussing legitimacy and the basic principles accompanying it.In the second chapter, we will first answer the question of what is meant by the concept of "functions" of the President and then analyze Article 126(1), which designates these functions. We will find out what is implied by the "supreme representation of the Republic of Poland" and the practical significance of the function of "guarantor of the continuity of state power.In the third chapter, we will elaborate on the tasks of the President of the Republic of Poland indicated in Article 126(2), i.e., "watching over the observance of the Constitution," "guarding the sovereignty and security of the state," and "guarding the inviolability and indivisibility of its territory." Consideration will be given to the relationship of the head of state with the council of ministers, the problem of the dispute of competence and the principles of interaction. Considerations are given to the general characteristics of the functions and tasks of the President of the Republic without discussing constitutionally and statutorily assigned competencies.
