Legal aspects of usage of surgical telemanipulators. Chosen issues

Mimo rosnącej popularności, wykorzystanie telemanipulatorów chirurgicznych nie jest jeszcze upowszechnione w Polsce. Na wstępie pracy dokonano próby zdefiniowania i usystematyzowania pojęcia "telemanipulator chirurgiczny" oraz jego klasyfikacji jako wyrób medyczny. Dalsza część pracy zawiera analizę zasad legalnego wykorzystania tych urządzeń w świetle obowiązujących przepisów. Dotyczy to zarówno zasad udzielania świadczeń zdrowotnych, jak i możliwych konsekwencji naruszenia tych reguł, rodzących odpowiedzialność cywilną lub karną. Ponadto w pracy zawarto analizę zagadnień dotyczących możliwości utrwalania zabiegów w formie nagrania oraz udzielania świadczeń zdrowotnych na odległość. Oprócz analizy obowiązujących przepisów, praca zawiera również liczne postulaty de lege ferenda.

In spite of growing popularity of usage of surgical telemanipulators, this method is not yet widely used in Poland. At the beginning of the thesis an attempt was made to define and systematize the concept of "surgical telemanipulator" and to classify it as a medical device. Following parts of the thesis contain an analysis of the principles of the legal use of these devices in the light of applicable regulations. This applies to both the rules for the provision of health services and the possible consequences of violating these rules, giving rise to civil or criminal liability. In addition, the thesis contains an analysis of issues regarding the possibility of recording treatments and providing health services at a distance. In addition to the analysis of applicable regulations, the work also contains numerous de lege ferenda postulates.
