Antitrust proceedings in cases of practices infringing collective consumer interests

Niniejsza praca magisterska poświęcona została problematyce dotyczącej naruszeń zbiorowych interesów konsumentów. Początkowa część pracy zawiera podstawowe zagadnienia, które mają związek z postępowaniem antymonopolowym prowadzonym przez Prezesa Urzędu Ochrony Konkurencji i Konsumentów. Głównym celem pracy jest wykazanie, w jaki sposób przebiega i na czym polega postępowanie antymonopolowe w sprawach praktyk naruszających zbiorowe interesy konsumentów. W pracy wykazane jest to, że jest to niezwykle sformalizowane postępowanie, które składa się z wielu faz, jak między innymi z postępowania dowodowego, które stanowi podstawę do wydania odpowiedniej decyzji kończącej postępowanie. Postępowanie antymonopolowe opiera się na przepisach różnych ustaw, w tym między innymi na przepisach Kodeksu postępowania administracyjnego, czy Kodeksu postępowania cywilnego. Z pracy można dowiedzieć się również, jakie istnieją decyzje kończące postępowanie, a także, jakie są ich funkcje oraz jakie kary i obowiązki Prezes Urzędu Ochrony Konkurencji i Konsumentów może nałożyć na przedsiębiorców dopuszczających się działań naruszających zbiorowe interesy konsumentów.

This Master's dissertation is related to the issue of violations of collective consumer interests. The beginning part of the dissertation is devoted to general matters related to the antitrust proceedings conducted by the President of the Office of Competition and Consumer Protection. The main aim of the dissertation is to demonstrate how antitrust proceedings in cases of practices infringing collective consumer interests are conducted and what they consist of. The dissertation shows that this is an extremely formalized procedure, which consists of many phases, such as taking evidence, which is the basis for issuing an appropriate decision ending the procedure. Antitrust proceedings are based on the provisions of various acts, including the provisions of the Code of Administrative Procedure or the Code of Civil Procedure. The dissertation also provides information on the decisions terminating the proceedings, as well as their functions and what penalties and obligations the President of the Office of Competition and Consumer Protection may impose on entrepreneurs who commit actions infringing collective consumer interests.
