The settlement and the mediation in the administrative proceeding

Celem niniejszej pracy jest szczegółowe przedstawienie ugody i mediacji w postępianiu administracyjnym. Obie te instytucję stanowią alternatywne metody rozstrzygania kwestii sporych. Na samym wstępie zostały omówione zagadnienia wprowadzające do tematu takie jak: ADR, przedmiotowy zakres obowiązywania k.p.a. czy znowelizowana zasada polubownego załatwiania sprawy. W niniejszym opracowaniu możemy odnaleźć definicję oraz krótki rys historyczny wprowadzenia ugody do postępowania administracyjnego. Ponadto zostały tutaj przedstawione przesłanki dopuszczalności jej zawarcia, procedura oraz skutki prawne. W kolejnej części zaprezentowano instytucję mediacji jako nową formę zakończenia sporu w k.p.a. Fragment ten stanowi odpowiedź na takie pytanie jak: czym jest mediacja, kto może zostać mediatorem, jak wygląda procedura przeprowadzenia postępowania mediacyjnego oraz jaki jest jego cel. W każdym z wyżej wymienionych tematów uwzględniono zmiany jakie zaszły w Kodeksie w związku z kwietniową nowelizacją z 2017 roku. Praca skłania do refleksji, iż ugodę i mediację, zarówno w Polsce jak i na świecie, w przyszłości czeka ogromny rozwój.

The purpose of my master’s thesis is the presentation of the settlement and the mediation in the administrative proceedings. The both institutions are classified as the alternative methods of dispute resolution. In the beginning of the thesis there are addressed the initial topics such as the ADR, the material scope of the Code of Administrative Procedure and the principal of conciliation. In the thesis you can also found the definitions and the historical background on the settlement in the administrative proceedings. Moreover, the conditions of a concluding the administrative settlement and it’s legal consequences were presented further. In the next part, I analyzed the mediation as a new method of dispute resolution in the Code of Administrative Procedure. This part is the answer for the questions: what is the nature of the administrative mediation? who can be a mediator? how does the mediation look like and what is the purpose for this procedure? In the all parts of the thesis I took into account the changes introduced by the 2017 amendment to the Code of Administrative Procedure. The master’s thesis encourages reflection that the settlement and the mediation in the administrative proceedings will develop dynamically both in Poland and in the world.
