Ombudsman in Poland - selected issues

Pierwszy rozdział będzie zawierał genezę powstania instytucji Rzecznika Praw Obywatelskich w Polsce i podstawy prawne jego działalności oraz powstawanie urzędu ombudsmana w Europie. Ponadto opiszę cechy jakimi powinien odznaczać się współczesny Rzecznik Praw Obywatelskich i źródła prawa dotyczące Rzecznika Praw Obywatelskich.Rozdział drugi odnosił się będzie do pozycji ustrojowej Rzecznika Praw Obywatelskich i jego miejsca w systemie organów państwowych. Opiszę wymagania formalne na stanowisko Rzecznika Praw Obywatelskich, zasadę incompatibilitas, procedurę wyboru i okres trwania kadencji Rzecznika Praw Obywatelskich, a także słowa ślubowania składanego przez Rzecznika po jego wyborze oraz procedurę odwołania i immunitet Rzecznika Praw Obywatelskich. Czynności podejmowanych przez Rzecznika Praw Obywatelskich dotyczył będzie rozdział trzeci. Wyszczególnię kto, w jakiej formie i w jakiej sprawie może złożyć do Rzecznika wniosek, jakie Rzecznik ma prawa związane z podjęciem przez niego sprawy oraz uprawnienia Rzecznika po zbadaniu sprawy.Rozdział czwarty dotyczyć będzie pozycji Rzecznika w postępowaniu administracyjnym i sądowoadministracyjnym. Nie będę omawiać całościowo ustaw o postępowaniu administracyjnym i sądowoadministracyjnym, lecz jedynie postaram się zaprezentować jaki udział, kompetencje i obowiązki przypadły w obu postępowaniach Rzecznikowi Praw Obywatelskich.W rozdziale piątym przedstawię współpracę Rzecznika Praw Obywatelskich z innymi podmiotami, coroczne informowanie Sejmu i Senatu przez Rzecznika Praw Obywatelskich o swojej działalności oraz o stanie przestrzegania wolności i praw człowieka i obywatela jak również działania zarówno Biura Rzecznika Praw Obywatelskich jak i jego terenowych pełnomocników.

The first chapter will contain the genesis of the Ombudsman institution in Poland and the legal basis of its activities, as well as the emergence of the Ombudsman office in Europe. Moreover, I will describe the qualities a modern ombudsman should have and the legal sources related to the Ombudsman.The second chapter will relate to the constitutional position of the Ombudsman and their place in the system of state. I will describe the formal requirements for the position of an ombudsman, the incompatibilita rule, the election procedure and the term of office for an ombudsman, as well as the words of the ombudsman’s oath spoken after their election, the dismissal procedure and Ombudsman’s immunity.The third chapter will relate to the activities undertaken by the Ombudsman. I will specify who, in what form and case may apply to the ombudsman, what rights the ombudsman has in relation to the considered case and the ombudsman’s rights after examining the case.The fourth chapter will be about the ombudsman’s position in administrative and administrative court proceedings. I will not comprehensively discuss the administrative and administrative court proceedings acts, only try to present what part, powers and duties would be given to the ombudsman in the both kinds of proceedings.The fifth chapter will present the cooperation of the Ombudsman with other entities, the annual information given to the Sejm and Senate by the Ombudsman about their activities and the status of compliance with the rights and freedoms of persons and citizens, as well as the activities of both the Ombudsman Office and its local representatives.
