Comparison Between General Data Protection Regulation and Law Number 27 Year 2022 on Personal Data Protection in Indnesia State Administrative System

Indonesia has finally enacted the Law on Personal Data Protection Bill into Law Number 27 Year 2022 on Personal Data Protection (Indonesia PDP Law). This significant step forward in safeguarding personal data in indonesia, which was previously governed by various regulations such as Government Regulations and Electronic Information and Transactions Law.Both Indonesia PDP Law and GDPR has standard criteria. Majority articles in Indonesia PDP Law refers to the GDPR as the global standard for implementing personal data protection not only in Europe, but also Globally. While adopting most principles from the GDPR, Indonesia has different legal system, there are some standard that can be connected and linked, namely definition of personal data, data transfer limitations and legal enforcement.Establishment of an independent authority for personal data oversight in Indonesia state administrative system is an essential aspect to implement this Indonesia PDP Law. Either new independent insitution or merged with existed institution, these has key role in effectively monitoring and enforcing personal data protection policy with principles adopted in GDPR global standard.
