Legal issues of surveillance in employment relationship

Praca zawiera analizę i krytykę regulacji monitoringu w miejscu pracy zawartej w Kodeksie Pracy. Autorka zwraca uwagę zarówno na problemy definicyjne jak i aksjologiczne, a także na problemy praktyczne mogące powstać podczas stosowania monitoringu w miejscu pracy. Główną cześć pracy stanowi analiza wpływu monitoringu na podstawowe prawa i obowiązki pracodawcy i pracownika oraz wykazanie licznych wad regulacji monitoringu w miejscu pracy zawartej w Kodeksie Pracy. Podsumowanie pracy nawiązuje do tezy pracy zgodnie z którą obecna regulacja monitoringu w miejscu pracy nie wzmacnia standardów ochrony podstawowych praw pracownika.

Thesis contains analysis and criticism of regulation of surveillance in workplace included in Polish Labour Code. The author brings awareness to problems of definitions as well as to problems with axiology also to practical problems which may arise during applying surveillance in workplace. The main part of thesis forms the analysis of the impact of surveillance on basic rights and obligations of employer as well as employee and display of multiple imperfections of the regulation of surveillance in workplace included in Polish Labour Code. The summary refers to thesis of the thesis according to which the current regulation of surveillance in workplace does not enhance the standards of protection of the basic employee’s rights.
