Liability of a spouse for the obligations of the other spouse in the statutory matrimonial regime

Celem niniejszego opracowania jest przedstawienie specyfiki odpowiedzialności małżonka majątkiem wspólnym za zobowiązania współmałżonka w ustroju wspólności ustawowej i nakreślenie problemów związanych z tym zagadnieniem. W rozdziale pierwszym pokrótce omówiono ewolucję zasad ponoszenia odpowiedzialności za zobowiązania przez małżonków na przestrzeni obowiązywania kodeksu rodzinnego i opiekuńczego. W rozdziale drugim zaprezentowano podstawowe założenia funkcjonowania ustroju wspólności ustawowej. Rozdział trzeci dotyczy solidarnej odpowiedzialności małżonków za zobowiązania wynikające z zaspokajania zwykłych potrzeb rodziny. Bardzo istotną część niniejszej pracy stanowi rozdział czwarty, w którym omówiono problematykę wyrażenia zgody przez małżonka na zaciągnięcie zobowiązania przez współmałżonka. Rozważania skupiają się wokół art. 41 k.r.o. mającego centralne znaczenie dla zagadnienia odpowiedzialności majątkowej małżonków wobec osób trzecich. Dalszy ciąg tych rozważań znajduje się w rozdziale piątym, w którym nacisk położono na charakter oraz zakres odpowiedzialności małżonków.

The purpose of this masters thesis is to present the issue of the responsibility of a spouse for the other spouses liabilities in the statutory matrimonial regime and to outline the problems associated with this issue. The first chapter briefly discusses the evolution of the rules of liability for the obligations of the spouses. The second chapter presents the basic concepts of functioning of the statutory marital property system. The third chapter concerns the joint and several liability of the spouses for the obligations arisen from meeting ordinary family needs. A very important part of this master`s thesis is the fourth chapter, which discusses the issue of consent of one spouse for entering a legal bond by the other spouse. Considerations are focused on art. 41 of the Family Code, which has central importance to the issue of liability of spouses to third parties. Continuation of these considerations is the fifth chapter, where the emphasis is laid on the nature and range of the responsibility of spouses.
