Influence of continuous act on the application of punishment

Niniejsza praca dotyka jednego z najbardziej spornych zagadnień polskiego prawa karnego – kwestii przestępstwa popełnionego w warunkach ciągłości. W szczególności przedmiotem rozważań jest instytucja czynu ciągłego oraz jej związek z wymiarem kary. Niniejsza praca została podzielona na dwie części. W części pierwszej znajdują się teoretyczne rozważania nad czynem ciągłym. Z uwagi na pozycję tej instytucji w polskim porządku prawnym, konieczne było poruszenie takich tematów jak znaczenie czynu oraz kryteria wyznaczania jedności/tożsamości czynu. Rozważania w tej części mają odpowiedzieć na pytania czy czyn ciągły może, przynajmniej na poziomie teoretyczno-dogmatycznym, stanowić podstawę do obostrzenia kary.Druga część pracy skupia się na wprowadzonym w 2020 roku art. 57b k.k., który dotyczy wymiaru kary dla sprawcy popełniającego czyn w warunkach ciągłości. Ta część pracy poszukuje odpowiedzi na pytania dotyczące charakteru instytucji zawartej w art. 57b k.k., a także o miejsce w polskim porządku prawnym. Konieczne było również sprawdzenie, czy sama nowelizacja daje się pogodzić z Konstytucją RP.

The author analyses one of the most contentious issues of the Polish penal law - the problem of a crime committed in conditions of continuity. In particular, the subject of consideration is the institution of a continuous act and its relationship with the punishment. The following work has been divided into two parts. The first part contains theoretical considerations on a continuous act. Due to the position of this institution in the Polish legal order, it was necessary to address topics such as the meaning of the act and the criteria for determining the unity/identity of the act. The considerations in this part are carried to answer the question whether a continuous act can, at least at the theoretical or dogmatic level, constitute the basis for making the penalty more severe.The second part of the work focuses on the Article 57b of the Polish Penal Code, which changes the rules of applying punishment for the perpetrator committing the act in conditions of continuity. This part of the work seeks answers to questions about the nature of this institution as well as tries to determine its place in the Polish legal order. It was also necessary to check whether the amendment itself was compatible with the Constitution of the Republic of Poland.
