The tripartite power in the light of the constitutional principles of the Republic of Poland

Celem pracy pt. Trójpodział władzy w świetle konstytucyjnych zasad ustrojowych RP jest przedstawienie trójpodziału władzy we współczesnej Polsce na tle innych konstytucyjnych zasad ustrojowych, które składają się na tożsamość konstytucyjną III RP. Zaprezentowano w niej teoretyczne aspekty konstytucyjnych zasad ustrojowych oraz dokonano przeglądu katalogów naczelnych zasad ustrojowych formułowanych przez prawników – konstytucjonalistów na bazie obowiązującej obecnie w Polsce Konstytucji z 1997 roku. Opisano klasyczną koncepcję trójpodziału władzy oraz jej realizację w różnych systemach rządów. Największa część pracy została poświęcona organom składającym się na aparat władzy państwowej w RP: władzy ustawodawczej, władzy wykonawczej i władzy sądowniczej – ich uprawnieniom, kompetencjom i roli w państwie. Starano się ukazać, że wieloaspektowość omawianej zasady powoduje, że – mimo ugruntowanie tradycji – ciągle jest ona przedmiotem różnych interpretacji i dyskusji.

The aim of the work "The separation of powers in the light of the constitutional principles of the Republic of Poland" is to show the separation of state powers in contemporary Poland against the background of other constitutional principles that create the constitutional identity of the Third Republic of Poland. It presents the theoretical aspects of the constitutional principles of the political system and reviews the catalogues of the supreme constitutional principles formulated by lawyers constitutionalists on the basis of the current Polish Constitution of 1997. The classic concept of separation of state powers and its realization in various government systems was described. The largest part of the work was devoted to the organs comprising the apparatus of state power in the Republic of Poland: legislative, executive and judiciary - their powers, competences and role in the state. It was attempted to show that the multifaceted nature of the discussed principle means that despite the established tradition, it is still the subject of various interpretations and discussions.
