A permissive approach to certain activities concerning psychoactive substances.

Niniejsza praca ma na celu przedstawienie rozwiązania "pośredniego" w zakresie traktowania problemu substancji psychoaktywnych, tj. podejścia permisywnego, pod którym należy rozumieć depenalizację bądź dekryminalizację niektórych czynności mających za przedmiot substancje psychoaktywne. Zasadniczo w pracy nie jest kwestionowana szkodliwość takich substancji. Wątpliwości poddana została natomiast skuteczność podejścia restrykcyjnego. Przedmiotem analizy są również negatywne konsekwencje wtórne stosowania reakcji prawnokarnej.W pierwszej kolejności podjęty został problem terminologii oraz podziału substancji psychoaktywnych wraz z krótką ich charakterystyką. W głównej części pracy omówione zostały trzy modele legislacyjne - restrykcyjny, legalizacyjny oraz permisywny, jak również poruszona została kwestia uregulowań szczególnych. Następnie zaprezentowane zostały sposoby implementacji założeń modelu permisywnego w wybranych ustawodawstwach. Na koniec przedstawiono analizę wyników badań własnych autora w zakresie omawianej problematyki.

The thesis' aim is to present the "intermediary" solution in terms of dealing with the problem of psychoactive substances, i.e. permissive approach, which term includes depenalization and decriminalization of certain activities concerning psychoactive substances. In principle, the harmfulness of such substances is not contested in the thesis. However, the effectiveness of the restrictive approach was questioned. Negative derivative consequences of criminal law response is also the subject of analysis.At the beginning, thesis handled with terminology's feature and psychoactive substances division with brief characteristic of them. In the essential part of the thesis three legislative models - restrictive, legalization and permissive were discussed. There was also raised the aspect of special arrangements. Afterwards, implementations' methods of permissive model assumptions in particular legislations were presented. In the end of the thesis, there were analyzed the bottom line performence of author's survey in terms of discussed issue.
