Cross-border health care in the European Union

Celem niniejszej pracy było przedstawienie poszczególnych typów procedur korzystania z transgranicznej opieki zdrowotnej w innym państwie członkowskim Unii Europejskiej, zarówno w oparciu o przepisy Rozporządzenia Rady i Parlamentu Europejskiego nr 883/2004 z dnia 29 kwietnia 2004 r. w sprawie koordynacji systemów zabezpieczenia społecznego, jak i Dyrektywy Parlamentu Europejskiego i Rady 2011/24/UE z dnia 9 marca 2011 r. w sprawie stosowania praw pacjentów w transgranicznej opiece zdrowotnej. Ponadto autorka, poprzez szczegółową analizę przepisów rozważyła, czy regulacje dotyczące korzystania ze świadczeń medycznych w innym państwie Unii Europejskiej dobrze spełniają swoją rolę, oraz oceniła, czy Polska jako kraj członkowski wywiązuje się ze swoich obowiązków nałożonych na nią w tym zakresie.Pierwszy rozdział pracy stanowi analizę kompetencji Unii Europejskiej w obszarze ochrony zdrowia, której celem jest udzielenie odpowiedzi na pytanie, czy przepisy unijne dotyczące leczenia transgranicznego nie wykraczają poza kompetencje nadane Unii w przepisach traktatowych. Ponadto, w rozdziale opisane zostało również pojęcie obywatela Unii Europejskiej, jako iż to właśnie w związku z uprawnieniami wynikającymi z nadania obywatelom państw członkowskich Unii Europejskiej statusu obywatela UE, rola ochrony zdrowia w Unii znacząco wzrosła.Drugi rozdział opisuje sposób skorzystania z transgranicznych świadczeń opieki zdrowotnej na podstawie przepisów tzw. Rozporządzenia koordynacyjnego, z podziałem na leczenie planowane oraz tryb nieplanowany.W kolejnym rozdziale autorka dokonała analizy orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej w zakresie korzystania ze świadczeń opieki zdrowotnej w innym państwie członkowskim, jako iż orzecznictwo Trybunału stanowiło impuls do rozpoczęcia prac legislacyjnych nad tzw. Dyrektywą transgraniczną. Procedura korzystania ze świadczeń zdrowotnych na podstawie przepisów Dyrektywy transgranicznej została opisana w następnym rozdziale pracy.Ostatni rozdział stanowi opis praktyki organów polskich w kwestii stosowania przepisów o transgranicznej opiece zdrowotnej, ze szczególnym uwzględnieniem statystyk Narodowego Funduszu Zdrowia dotyczących leczenia transgranicznego.

The aim of this work was to present the types of procedures, which patients have to follow while taking advantage of cross- border health care in another European Union country, including the distinction between the Regulation No 883/2004 of the European Parliament and of the Council of 29 April 2004 on the coordination of social security systems and the Directive 2011/24/EU on the application of patients’ rights in cross- border healthcare.Moreover, the author considered if the regulations regarding cross- border health care in the European Union fulfil their purpose and assessed if Poland, as a member state, accomplishes its’ duties imposed on the Polish authorities in this area. The first chapter contains an analysis of the competences of the European Union in the field of health protection. The aim of this study is to answer a question if the regulations on the cross- border health care do not go beyond the general competences of the European Union. Furthermore, this chapter describes also the concept of the Citizenship of the European Union, as the role of health protection in the European Union increased because of the rights given to the people having a status of the European Union citizen.The second chapter describes the way of taking advantage of cross border health care on the basis of the Regulation No 883/2004 of the European Parliament and of the Council of 29 April 2004 on the coordination of social security systems, with a division on planned and unplanned procedures.In the next chapter the author analysed the case-law of the European Court of Justice in the scope of cross border health care in the European Union, as this case-law constituted an impulse to start working on the legislative proposal of the Directive 2011/24/EU on the application of patients’ rights in cross- border healthcare. The above mentioned Directive was described in the next chapter.The last chapter describes the practice of the Polish authorities while using the regulations on cross- border health care, with a special regard to the statistical data from the Polish National Health Fund about the cross- border health protection.
