Nabywając własność lokalu, właściciel nabywa jednocześnie udział w nieruchomości wspólnej i staje się członkiem wspólnoty mieszkaniowej. W ten sposób po jego stronie powstają różnego rodzaju prawa i obowiązki.Zarówno prawa jak i obowiązki właściciela lokalu można rozpatrywać na dwóch płaszczyznach. Z jednej strony właściciel lokalu posiada prawa dotyczące jego własnego lokalu. Prawa te jednak w pewien sposób ograniczają ustawy i zasady współżycia społecznego.Z drugiej strony właścicielowi lokalu przysługują prawa dotyczące nieruchomości wspólnej wynikające z faktu bycia członkiem wspólnoty mieszkaniowej. Analogicznie - obowiązki spoczywające na każdym właścicielu dotyczą zarówno utrzymania jego własnego lokalu, ale także konieczności ponoszenia ciężarów związanych z utrzymaniem części wspólnej. Realizacja poszczególnych praw i obowiązków przez właścicieli nieruchomości lokalowych zapewnia prawidłowe funkcjonowanie wspólnoty mieszkaniowej.

By analogy the responsibilities resting with every owner concern both the upkeep of his own property and also the necessity of bearing the burden associated with the upkeep of the communal parts. The realization of specific rights and responsibilities by the owner of real-estate property ensures the correct functioning of a residential community.
