Participation of the prosecutor in administrative proceedings and administrative court

Przedmiotem opracowania jest prokurator w postępowaniu administracyjnym i sądowoadministracyjnym. Kodeks postępowania administracyjnego w dziale IV określa rolę prokuratora. Rola ta polega na strzeżeniu praworządności. W pracy magisterskiej dokonałam charakterystyki historii prokuratury oraz jej zadań. Następnie przedstawiłam prokuratorską kontrolę przestrzegania prawa, która zajęła miejsce nadzoru ogólnego. W dalszej części scharakteryzowałam ogólne zasady postępowania administracyjnego, z wyszczególnieniem zasady praworządności, gdyż z punktu widzenia prokuratora jest ona najważniejsza. Potem odniosłam się do pozycji prokuratora w postępowaniu administracyjnym. Poddałam analizie uprawnienia, które przysługują prokuratorowi w tym postępowaniu: żądanie wszczęcia postępowania w celu usunięcia stanu niezgodnego z prawem, prawo do udziału w każdym stadium postępowania, a także prawo wniesienia sprzeciwu od decyzji ostatecznej. W kolejnej części zajęłam się opisaniem legitymacji skargowej, którą posiada prokurator. Następnie scharakteryzowałam: skargę prokuratora na akty prawa miejscowego, wniosek o rozstrzygnięcie sporu kompetencyjnego przez Naczelny Sąd Administracyjny, skargę na przewlekłość postępowania sądowoadministracyjnego. Kolejnym rozważaniem są zwyczajne środki zaskarżenia: skarga kasacyjna do Naczelnego Sądu Administracyjnego oraz zażalenie do Naczelnego Sądu Administracyjnego.

The study is the prosecutor in administrative proceedings and administrative court. The Administrative Procedure Code and Section IV specifies the role of the prosecutor. This role involves guarding the rule of law. In the thesis I made the characteristics of the history of the prosecution and its tasks. Then I introduced prosecutor's enforcement of the law, which took the place of general surveillance. In later I described the general principles of administrative proceedings, detailing the rule of law, because from the standpoint of a prosecutor is paramount. Then I got to the position of prosecutor in administrative proceedings. Analyzed the powers enjoyed by the prosecutor in the investigation: a request to initiate proceedings to rectify the situation with the law, the right to participate at any stage of the proceedings and the right to lodge an objection against the final decision. In the next part I got into describing the legitimacy of complaints board, which has the prosecutor. Then, I characterized: the prosecutor's complaint against acts of local law, the request for the question of competence by the Supreme Administrative Court a complaint against the excessive length of administrative litigation. Another consideration is the ordinary means of challenging an appeal in cassation to the Supreme Administrative Court and appealed to the Supreme Administrative Court.
