Monument as a subject of legal protection

Celem pracy pt. "Zabytek jako przedmiot ochrony prawnej" jest prezentacja problemu ochrony zabytków i dziedzictwa kulturowego w Polsce. Już na wstępie podkreślono, iż kluczową rolę w tej kwestii odgrywają organy jednostek samorządu terytorialnego, wyposażone w zróżnicowane instrumenty prawne. Rozważania merytoryczne rozpoczynają uwagi na temat istoty samego zabytku, odwołując się do najważniejszych aktów prawnych, podkreślając jednocześnie jak ważna jest współpraca w zakresie omawianej kwestii na poziomie zarówno krajowym, jak i europejskim i światowym. Dotyczy także różnorakich form ochrony zabytków w Polsce, których omówienie zajmuje sporo miejsca w opracowaniu. Ważny wątek rozważań dotyczy organizacji rządowych i pozarządowych, których celem jest ochrona zabytków,a także innych elementów wchodzących w skład dziedzictwa kulturowego. Rozważania w tym obszarze uzupełniają uwagi na temat faktycznej roli jednostek samorządu terytorialnego w ochronie zabytków, oraz kwestia finansowania ochrony, zamykająca całość wywodu.

The purpose of this study was to investigate the issue of legal protection of monuments and the cultural heritage in Poland. At the outset, it was emphasized that the key role in this matter is played by bodies of local government units equipped with various legal instruments. Next section of the project highlights the comments on the essence of the monument itself, referring to the most important legal acts, while stressing the importance of cooperation on this issue at the national as well as European and global level. The study also applies to various forms of protection of monuments in Poland, the discussion of which takes up a lot of space in the study. An important element of reflections concerns governmental and non-governmental organizations whose aim is to preserve monuments and other elements of cultural heritage. Considerations in this area are complemented by comments on the actual role of local self-government units in the protection of monuments, and the issue of financing protection, which closes the whole of the elaboration.
