Legal pluralism in Ecuador: the Kichwa Indians'own law

Niniejsza praca jest próbą przybliżenia prawa własnego Indian Kichwa. Przedstawiono w niej główne cechy konstytutywne prawa zwyczajowego wyodrębniając różnice pomiędzy nim, a prawem powszechnym oraz ukazano zjawisko pluralizmu prawnego, legalnie uznanego w Ekwadorze wraz z nowelizacją Konstytucji z 1998 i z 2008 roku obowiązującą obecnie. Następnie omówiono struktury organizacyjne wspólnoty oraz obowiązujące wartości z uwzględnieniem tych tradycyjnych. Opisano mechanizmy, które się uruchamiają w momencie powstania sytuacji konfliktowej, wyodrębniając poszczególne etapy dochodzenia wraz ze stosowanymi sankcjami. Na końcu zwrócono uwagę na istniejące napięcia między prawem powszechnym, a prawem własnym Indian.

This work is an attempt to approximate the proper law of Kichwa Indians. It also presents the main features of the common law constitutive extracting the differences between him and the common law, and shown the phenomenon of legal pluralism, legally recognized in Ecuador with the amendment of the Constitution of 1998 and 2008 years at present in force. It then discusses the organizational structure of the community, and taking into account the current value of these traditional. Describes the mechanisms that have run at the time the conflict situation, identifying the various stages of the investigation, together with the applicable sanctions. Finally, attention was drawn to the existing tensions between the common law and the law of self-Indians.
