Celem niniejszej pracy dyplomowej jest ukazanie tego, jak funkcjonuje w polskim procesie karnym instytucja swobody wypowiedzi, z naciskiem na wpływ doktryny oraz orzecznictwa na kształt wspomnianego pojęcia.Rozdział pierwszy potraktowany został jako wstęp mający dać czytelnikowi ogólny zarys pojęć potrzebnych do zrozumienia głównego tematu. Znalazły się tu pojęcia dowodów i ich kategoryzacja.Rozdział drugi odnosi się do ogólnej charakterystyki przesłuchania i związanej z nim osoby przesłuchiwanej, pytań, jakie można zadawać podczas przesłuchania, oraz etapu swobodnej relacji.Rozdział trzeci został poświęcony próbie określenia pojęcie swobody wypowiedzi. Rozdział czwarty stanowi próbę zdefiniowania pojęcia swobody wypowiedzi za pomocą okoliczności, które przyczyniać się mogą do jej braku albo też nie mają na nią wpływu.Rozdział piąty odnosi się do problemu stosowania podstępu w procesie karnym, a zwłaszcza podczas czynności przesłuchania.Rozdział szósty porusza zagadnienie eliminacji dowodu uzyskanego wbrew zakazom dowodowym związanym ściśle z pojęciem swobody wypowiedzi

The purpose of this thesis is to present the function of freedom of expression in the Polish trial. The emphasis is put on the impact of the doctrine and jurisprudence.The first chapter serves as an introduction involving all the necessary information needed for the comprehension of the main theme. There is an overview of the terms connected with the evidence and its categorization.The second chapter is about hearings, the questions that can be asked during the interview and free will.The third chapter is an attempt to define the notion of freedom of expression. In the fourth chapter an attempt is made to define the notion of freedom of expression by circumstances which may contribute to its lack The fifth chapter discusses the problem of deception during the trial with reference to the hearings.The last chapter elaborates on the issue of elimination of evidence obtained in spite of the strict prohibitions of evidence related to the concept of freedom of expression.
