Despite the personal data protection law based on the European standards, none of the three North African countries has reached, as yet, the status of a country with an adequate level of protection in this regard. This article presents the factors affecting the poor implementation of the data protection law. Particular attention was devoted to Tunisia - the pioneer among the countries of Africa and the Middle East implementing the above mentioned legislation. It remains the only country of the region and the fourth non-European country to have acceded to the Convention 108 of the Council of Europe for the Protection of Individuals with regard to Automatic Processing of Personal Data, witch has been opened for signature also to non-member states since 1981.
