dc.abstract.pl Artykuł dotyczy relacji pomiędzy upadkiem zabezpieczenia na podstawie art. 742 § 1 zd. 2 KPC, tj. wskutek złożenia przez obowiązanego na rachunek depozytowy Ministra Finansów sumy zabezpieczenia żądanej przez uprawnionego we wniosku o udzielenie zabezpieczenia, a dopuszczalnością równoległego kwestionowania przez obowiązanego zasadności udzielonego przez sąd zabezpieczenia w trybie zażaleniowym. W wyniku przeprowadzonej analizy autor doszedł do wniosku, że wbrew dominującemu w tym zakresie stanowisku, upadek zabezpieczenia ex lege wskutek złożenia przez obowiązanego na rachunek depozytowy Ministra Finansów sumy zabezpieczenia żądanej przez uprawnionego we wniosku o udzielenie zabezpieczenia, nie czyni zażalenia na postanowienie o udzieleniu zabezpieczenia bezprzedmiotowym, skutkując jego niedopuszczalnością. Upadek zabezpieczenia na podstawie art. 742 § 1 zd. 2 KPC wiąże się bowiem wyłącznie ze zniweczeniem z mocą ex nunc skuteczności postanowienia o udzieleniu zabezpieczenia w zakresie przewidzianych w nim sposobów zabezpieczenia, bez eliminacji bytu prawnego samego postanowienia o udzieleniu zabezpieczenia, jako przedmiotu zaskarżenia zażaleniem pl
dc.abstract.en The article concerns the relationship between the cancellation of the interim measure (court-ordered security) under the Art. 742 § 1 sentence 2 of the Code of Civil Procedure (CCP), i.e. as a result of depositing by the obligor the amount of security requested by the obligee in his petition for security into the Minister of Finance deposit banking account, and the admissibility of parallel questioning by the obligor legitimacy of the court-ordered security by means of a complaint against judicial decision providing for the measure in question. As a result of the analysis, the author came to the conclusion, that contrary to the position dominant in the case law and literature, the ipso iure cancellation of the interim measure as a result of the provision by the obligor of the security requested by the obligee in the application for the interim measure does not make a complaint against granting interim measure objectless, resulting in its inadmissibility. Cancellation of security under the Art. 742 § 1 sentence 2 KPC by the operation of law results only in the ex nunc annulment of the effectiveness of a decision on granting interim measure of protection in the scope of the means of security provided for therein, without eliminating the legal existence of the decision on granting the security, as the object of appellate challenge by means of complaint pl
