In Polish labour law system both employees and unions are responsible for conducting an illegal strike or other protest action.Various liability regimes apply in those situation: tort, contractual and employee-based. In practice, it results in various problems and rationally unjustifi ed diff erentiation of the type of responsibility for participation in illegal collective action.
