Głównym celem monografii jest wskazanie zastosowania praw i wolności określonych w Konstytucji RP w zakresie tzw. stosunków horyzontalnych, czyli stosunków między podmiotami prywatnymi. Tradycyjnie przyjmuje się, że konstytucja reguluje stosunki między jednostką a państwem (tzw. stosunki wertykalne), podczas gdy stosunki między podmiotami prywatnymi są regulowane przez akty prawne niższej rangi. Takie postrzeganie roli konstytucji nie przystaje do obecnej rzeczywistości, w której prawa konstytucyjne są naruszane częściej przez podmioty prywatne niż przez państwo.

The main purpose of this book is to determine the applicability of the rights and freedoms specified in the Constitution of the Republic of Poland in view of the so-called horizontal relationships, i.e. the relations between private entities. Traditionally it is assumed that the constitution regulates the relations between an individual and the state (the so-called vertical relationships), whereas the relations between private entities are regulated by the legal acts of lower rank. Such an understanding of the role of the constitution does not correspond with the current realities in which the constitutional rights are more and more often violated by the private entities and not by the state.
