Niniejszy artykuł dotyczy problemu wpływu umorzenia postępowania w sprawie europejskiego nakazu zapłaty na podstawie art. 50519 § 4 k.p.c. w zw. z art. 7 ust. 4 zd. I i art. 17 ust. 1 zd. I Rozporządzenia (WE) nr 1896/2006, a zatem, na żądanie powoda, zgłoszone na wypadek wniesienia przez pozwanego sprzeciwu od ENZ, na przerwę przedawnienia wywołaną wszczęciem tego postępowania. Z uwagi na brak uregulowania kwestii skutków zakończenia postępowania w sprawie europejskiego nakazu zapłaty w tym trybie, jej rozstrzygnięcie zostało pozostawione prawodawcom krajowym. W tym zakresie, w ramach przepisów uzupełniających i wykonawczych zawartych w rozdziale 1 działu VII, tytułu VII Księgi pierwszej, Części pierwszej k.p.c., ustawodawca polski ograniczył się do unormowania kwestii kosztów umorzonego postępowania, odsyłając w tym zakresie do regulacji przyjętej dla cofnięcia powództwa w zwykłym procesie cywilnym. W rezultacie powyższego, rozstrzygnięcia wymaga problem, czy umorzenie postępowania wskutek wniesienia przez pozwanego sprzeciwu od ENZ, poprzedzonego żądaniem przez powoda zakończenia postępowania w takim wypadku, powoduje zakończenie przerwy przedawnienia wywołanej wszczęciem postępowania oraz ustanie innych materialno-prawnych skutków wytoczenia powództwa z mocą ex nunc, czy też, w oparciu o analogiczne zastosowanie regulacji dotyczącej cofnięcia pozwu (art. 203 § 2 zd. I k.p.c.), należy przyjąć, że umorzenie postępowania w oparciu o ww. regulację pociąga za sobą likwidację materialno-prawnych skutków wytoczenia powództwa (w tym przerwy przedawnienia), tj. działa z mocą retroaktywną (ex tunc), powodując, iż pozew nie wywołuje żadnych skutków, jakie ustawa wiąże z wytoczeniem powództwa. Po szczegółowemu przeanalizowaniu argumentów przemawiających za ww. konkurencyjnymi stanowiskami, autor stanął na stanowisku, iż w obowiązującym stanie prawnym brak jest wystarczających przesłanek dla rozciągnięcia na instytucję unormowaną w art. 50519 § 4 k.p.c. w zw. z art. 7 ust. 4 zd. I i art. 17 ust. 1 zd. I Rozporządzenia nr 1896/2006, skutków przewidzianych dla cofnięcia powództwa. Jednocześnie wskazano, iż obowiązujące unormowanie budzi wątpliwości z punktu widzenia założenia przewidywalności prawa procesowego i jako takie wymaga interwencji ustawodawczej, prowadzącej do jednoznacznego przesądzenia analizowanego problemu, w sposób eliminujący dostrzeżone wątpliwości interpretacyjne. |

This article addresses the problem of the impact of the termination of the European order for payment proceeding pursuant to art. 50519 § 4 of the Polish Code of civil procedure (hereinafter: "c.c.p.") applied in conjunction with art. 7 § 4 sentence I and art. 17 paragraph. 1 sentence I of the Regulation (EC) No 1896/2006 of the European Parliament and of the Council of 12 December 200 creating a European order for payment procedure (hereinafter: "Regulation No 1896/2006") at the request of the claimant made in the event of opposition by the defendant on the interruption of the limitation period induced by the initiation of this proceeding. Due to the lack of covering the effects of the termination of the European order for payment proceedings in the discussed mode in the Regulation no 1896/2006, the decision on how to resolve this issue was left to national legislators. In this regard, within the scope of supplementary and executive rules contained in Section 1 of Chapter VII, Title VII of Book One, Part One of the c.c.p., the Polish legislator chose to regulate only the issue of the costs of terminated proceedings, by reference to the rules adopted for the withdrawal of the complaint in the ordinary civil proceedings. As a result of that failure to regulate remaining effects of termination of the European order for payment proceeding, one must determine whether such termination pursuant to the provisions in questions shall cause the cessation of the interruption of the limitation period caused by the commencement of this proceeding resulting in starting its run anew or - based on the analogous application of the provisions governing withdrawal of a complaint in the ordinary civil proceeding - shall it rather lead to the annulment of the interruption of the run of the limitation period causing the restoration and continuation of its previous run. After a detailed analysis of the respective arguments supporting the abovementioned contradictory positions, the author took the view that in the current state of the law there are no sufficient grounds to extend the application of the provisions governing the effects of the withdrawal of the complaint to the institution provided for in to art. 50519 § 4 of c.c.p. applied in conjunction with art. 7 § 4 sentence I and art. 17 paragraph. 1 sentence I of the Regulation No 1896/2006 - beyond the scope explicitly mentioned in art. 50519 § 4 of c.c.p., which refers to the costs of proceedings Moreover the author indicated that the currently applicable regulation on the analyzed issue raises serious concerns from the point of view of the predictability of procedural law and as such needs to be clarified through explicit, unambiguous regulation eliminating interpretative doubts explained in details in this paper. |
