Tematem artykułu jest włoskie prawo arbitrażowe, ze szczególnym uwzględnieniem pozycji sędziego w postępowaniu przed sądem polubownym. Analizie poddane zostały przepisy włoskiej procedury cywilnej, które regulują kwestię przebiegu postępowania arbitrażowego we włoskim porządku prawnym. W pracy opisane zostały zasady, wedle których toczy się przedmiotowe postępowanie. Podkreślony został również fakt, jak silna jest w tym zakresie pozycja stron, które w przeważającej mierze mogą ukształtować postępowanie wedle własnego uznania. Omówiony został także problem bezstronności składu orzekającego w postępowaniu przed sądem polubownym oraz ewentualnej odpowiedzialności arbitrów za błędy bądź zaniechania podczas sprawowania swojej funkcji.

Topic of this article takes into account position of the judge before the arbitration court according to Italian law. The provisions of the Italian civil procedure, which govern the conduct of arbitration in the Italian legal system, have been analyzed. The paper describes the rules according to which the proceedings are being conducted. It also emphasized the fact that the position of the parties is strong. They can largely shape the proceedings at their own discretion. The issues of the impartiality of the composition of the arbitral tribunal proceedings and the arbitrators' liability for errors or omissions in the performance of their functions were also discussed.
