Article 17 of Directive 2019/790 - characteristics and implementation into Polish law

Niniejsza praca skupia się na scharakteryzowaniu artykułu 17 Dyrektywy Parlamentu Europejskiego i Rady (UE) 2019/790 z dnia 17 kwietnia 2019 r. w sprawie prawa autorskiego i praw pokrewnych na jednolitym rynku cyfrowym oraz zmiany dyrektyw 96/9/WE i 2001/29/WE oraz opisaniu prac nad jego implementacją do polskiego prawa. Przedstawiona została w ogólnym ujęciu sama dyrektywa, a szczegółowej analizie poddano jej art. 17 wprowadzający nowy system odpowiedzialności dostawców usług udostępniania treści online za przechowywane na ich serwerach treści, a także polski Projekt ustawy z dnia 23 marca 2023 r. o zmianie ustawy o prawie autorskim i prawach pokrewnych oraz niektórych innych ustaw implementujący między innymi art. 17 wspomnianej dyrektywy. Skupiono się na jak najszerszym przedstawieniu założeń i treści art. 17 dyrektywy DSM, charakterystyce odpowiedzialności podmiotów, do których jest on skierowany i mechanizmów, jakie wprowadza, a także na problematyce skuteczności przyjętych przez polskiego ustawodawcę rozwiązań w zakresie rzetelnej ich implementacji.

This paper focuses on characterizing Article 17 of Directive (EU) 2019/790 of the European Parliament and of the Council of April 17, 2019 on copyright and related rights in the digital single market and amending Directives 96/9/EC and 2001/29/EC, and describing the work on its implementation into Polish law. The Directive itself was presented in general terms, and its Article 17 introducing a new system of liability of online content service providers for content stored on their servers was analyzed in detail, as well as the Polish Draft Act of March 23, 2023 amending the Act on Copyright and Related Rights and certain other acts implementing, among other things, Article 17 of the said Directive. The focus is on the widest possible presentation of the assumptions and content of Article 17 of the DSM Directive, the characteristics of the responsibility of the entities to which it is addressed and the mechanisms it introduces, as well as the issue of the effectiveness of the solutions adopted by the Polish legislator in terms of reliable implementation.
