W artykule poddano analizie uprawnienia i obowiązki nieletniego odpowiadającego na podstawie ustawy z 26 X 1982 r. o postępowaniu w sprawach nieletnich, a niekiedy również na podstawie przepisów Kodeksu karnego. Na podstawie wskazanych ustaw za czyn karalny odpowiada sprawca, który ukończył 17 lat, a za demoralizację osoba, która nie ukończyła 18 lat. W tekście wymieniono źródła prawa krajowego i międzynarodowego regulujące pozycję nieletniego w tym postępowaniu. Rozważania koncentrują się wokół zagadnienia prawa do obrony nieletniego w postępowaniu w sprawach nieletnich i prawa do obrony oskarżonego na podstawie przepisów k.p.k. W tekście omówiono również problem odpowiedniego stosowania przepisów k.p.k. i k.p.c. w tym postępowaniu. Autor udowadnia, że od 2014 r. postępowanie w sprawach nieletnich ma charakter cywilny, a nie karny, a pozycja procesowa nieletniego jest bardzo podobna do sytuacji prawnej oskarżonego w postępowaniu karnym.

The article concerns the rights and obligations of a minor under the Juveniles Proceedings Act on 26 october 1982. The author also considers the issue of the accordingly application of Code of Criminal Procedure and Code of Civil Procedure. The author proves that since 2014, proceedings in juvenile cases is a civilian nature, not criminal, and the position of the juvenile is very similar to the legal situation of the accused in criminal proceedings.
