Zmiana natury konfliktów zbrojnych pod koniec XX i na początku XXI wieku pozwoliła zaobserwować bardzo niepokojące zjawisko– występowanie wśród uczestników dzieci, rozumianych jako każda osoba poniżej 18 roku życia. Dzieci są kurierami, pracownikami obozów wojskowych, niewolnikami dowódców grup zbrojnych oraz żołnierzami. Zabijają i torturują na rozkaz. Są kaleczone i giną jak dorośli żołnierze w wojnie, której nie rozumieją, za przekonania lub w imię interesów, które nie są ich. Praca ta skupia się na kompleksowej problematyce dzieci – żołnierzy, ich statusie prawnym, historii zjawiska, jego przyczynach oraz próbie rozwiązań problemu. Zebrane informacje pochodzą zarówno z aktów prawa międzynarodowego jak konwencje i protokoły, książek znawców tematu jak i z raportów osób, które przeprowadziły wywiady wśród byłych lub obecnych dzieci żołnierzy na całym świecie. Choć obecnie problem ten ma tendencje zniżkową, a jego występowanie zostało ograniczone do dwóch kontynentów: Azji i Afryki, nie znaleziona jeszcze rozwiązania, które by pomogło zniwelować, jeśli nie zlikwidować, owego zjawiska. Praca ta ma za zadanie przedstawić problem, uzmysłowić iż jest on niestety już nieodłączną cechą współczesnych wojen, ale jednocześnie, iż jest możliwa walka z tym procederem o ile problem zostanie poznany dogłębnie. Powierzchowna wiedz może powodować więcej złego niż dobrego.

The changing nature of armed conflict in the late twentieth and early twenty-first century made it possible to observe a very disturbing occurrence - the presence of children, defined as any person under 18 years of age, among the participants of armed conflicts. Children become couriers, workers on military camps, slaves of commanders of armed Groups, and soldiers. They kill and torture at the behest. They are crippled and killed as adults soldiers in a war they do not understand, for the conviction or the interests, that are not theirs. This paper focuses on the complex problems of children – soldiers: their legal status, the history of the occurrence, its causes and possible solutions to the problem. The gathered information come from both international law documents such as conventions and protocols, expert`s books on the subject, as well as from reports written by the people who carried out the interviews with former or current child soldiers around the world. While the current statistics tends downward, and its presence has been limited to two continents of Asia and Africa, nobody found a solution that would help alleviate, if not eliminate, this problem. This paper aims to present a problem, visualize that he is, unfortunately, an inherent feature of modern warfare, but at the same time, that it is possible to fight against these practices if the problem is thoroughly understood. Superficial knowledge can cause more harm than good.
