Niniejsza praca jest próbą zebrania najważniejszych informacji dotyczących kary ograniczenia wolności – jej genezy, uzasadnienia jej stosowania, zmieniającego się kształtu, szczególnie w perspektywie zbliżających się zmian. Starano się ukazać zarówno zagadnienia dotyczące początków kary ograniczenia wolności w Polsce, treści tej kary na gruncie kolejnych kodyfikacji karnych, jak i jej wykonywania na przestrzeni lat. W opracowaniu ujęto ponadto przyszłe zmiany w zakresie kary ograniczenia wolności w Polsce.Głównym celem niniejszej pracy jest analiza normatywna kary ograniczenia wolności w świetle polskiego ustawodawstwa od początku jej funkcjonowania do stanu prawnego po zmianach z 1 lipca 2015 roku. Ponadto, zostaną wskazane również takie kwestie jak uzasadnienia i cele poszczególnych zmian, by lepiej pokazać jak i dlaczego kara ograniczenia wolności w Polsce doznawała tak częstych modyfikacji. Przedstawiono i poddano analizie także dane statystyczne dotyczące orzekania kary ograniczenia wolności w polskich sądach. Ma to na celu ukazanie zmian i tendencji w zakresie orzekania tej kary w Polsce.

This thesis is an attempt to gather crucial information about restriction of liberty penalty - its origins, motivation for its use and changes in the form, especially in perspective of the upcoming amendments. Efforts were made to present both issues concerning the origins of restriction of liberty in Poland and essence of the penalty on the basis of subsequent codification of the criminal law as well as its execution over the years. This study also includes future changes in the field of restriction of liberty penalty in Poland.The main purpose of this paper is the analysis normative of restriction of liberty in Polish legislation from the beginning of its functioning until the legislation in force as after changes from July 1st, 2015. Furthermore, matters such as justification and objectives of particular changes will be indicated in order to demonstrate how and why the penalty of restriction of liberty in Poland underwent such frequent modifications. Also statistical data of sentencing the restriction of liberty penalty in the Polish courts was presented and analyzed. This is to show changes and trends in the field of sentencing in Poland.
