Praca została poświęcona analizie ewolucji ustroju samorządu gminnego w Polsce po 1990 roku. Dokonuje tej analizy z punktu widzenia normatywnego, ustrojowego oraz zadań, kontroli i nadzoru. Rozdział traktujący o zmianach normatywnych dokonuje analizy z punktu widzenia konstytucji, ustaw ustrojowych oraz ustaw traktujących o pracownikach samorządowych jak i ordynacjach wyborczych normujących wybory organów gminy. Rozdział dotyczący zmian ustrojowych dokonuje analizy pozycji gminy w ramach ustroju państwa i administracji publicznej, struktury gminy: organu stanowiącego, organu wykonawczego oraz jednostek pomocniczych. Zawiera także informacje dotyczące gminy w Polsce a więc stanowi opis gminy wiejskiej, miejskiej i miejsko-wiejskiej. Dodatkowo dokonuje analizy gminy miejskiej na prawach powiatu oraz szczególnego ustroju miasta stołecznego Warszawy. Dla dopełnienia całości rozważań autor poświęcił w rozdziale trzecim miejsce dla analizy zadań, kontroli i nadzoru nad samorządem gminnym co pozwala w sposób stosunkowo całościowy zamknąć analizę ewolucji ustroju gminy w ramach III Rzeczpospolitej Polski. Praca ma na celu w związku z powyższym odpowiedzieć w jakim kierunku ów ewolucja zmierza, a także w jaki sposób gmina może stać się przewodnim źródłem partycypacji obywateli w ramach demokratycznego ustroju państwa. |

The following thesis is devoted to the analysis of the communal self-government system in Poland past the year 1990. The analysis was conducted from three perspectives: normative, system-wide, as well as considering the tasks, controlling role and supervision. The chapter connected with the normative changes presents the analysis done from the perspective of the constitution, system-wide enactments, as well as the enactments concerning both the self-government officials and electoral entails regulating elections of the administrative bodies. The chapter devoted to the system-wide changes contains the analysis of the commune’s position in the state system and the public administration, the structure of the commune: the legislative body, the executive body, and the subsidiary units. It also provides information concerning the communes in Poland such as a description of a village community, a borough and the combination of the two. In addition to that, the chapter contains the analysis of a borough with county rights as well as the capital city of Warsaw’s system in particular. In order to present a full scope of the researched thesis, in chapter three, the author presents the analysis of the tasks, control and supervision of the communal self-government, which enables the completion of the analysis of the communal self-government system in Poland. As a result, the aim of the following thesis is to answer the question of where the mentioned evolution is headed, as well as to determine the way for a commune to become the primary source of the citizens’ participation in the functioning of a democratic state system. |
